O-08-07 01/08/2007VILLAGE OF LE O ORDINANCE NO.() AN ORDINANCE GRANTING VARIATIONS FROM THE STANDARD SPECIFICATIONS FOR THE DESIGN AND CONSTRUCTION OF PUBLIC IMPROVEMENTS AND PRIVATE SITE IMPROVEMENTS FOR 1384 STATE STREET IN LEMONT, ILLINOIS APPROVED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 8TH DAY OF JANUARY , 2007 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DUPAGE, ILLINOIS, THIS 8TH DAY OF JANUARY, 2007 ORDINANCE NO. 0 O7 AN ORDINANCE GRANTING VARIATIONS FROM THE STANDARD SPECIFICATIONS FOR THE DESIGN AND CONSTRUCTION OF PUBLIC IMPROVEMENTS AND PRIVATE SITE IMPROVEMENTS FOR 1384 STATE STREET IN LEMONT, ILLINOIS WHEREAS, Lester Wesner, hereinafter referred to as "the Petitioner ", owner of a parcel at 1384 State Street in Lemont, Illinois, hereinafter referred to as "the subject property", in Lemont, Illinois; said parcel is legally described in "Exhibit A" attached to this Ordinance; and WHEREAS, the applicant is seeking a variation from The Standard Specifications for the Design and Construction of Public Improvements and Private Site Improvements, §2.02.A requiring provisions for the construction of streets and appurtenances and §7.02.A. 1 requiring storm water detention; and WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois (the "Village ") did recommend approval of the variations request by a 6 -0 vote with one absent on September 5, 2006; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Daily Southtown a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the variation as described herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND WILL, ILLINOIS: SECTION 1: Subdivision Fronting a Public Right -of -Way: A variation is approved from The Standard Specifications for the Design and Construction of Public Improvements and Private Site Improvements, §2.02.A, requiring provisions for the construction of streets and appurtenances. SECTION 2: On -site Storm Water Detention: A variation is granted from The Standard Specifications for the Design and Construction of Public Improvements and Private Site Improvements, §7.02.A.1 requiring storm water detention. SECTION 3: Condition of Approval: The above variations shall be approved subject to the following conditions: 1. The variation shall expire after one year from the date of Village Board approval if at that time the petitioner has not yet applied for and received a building permit.
