VILLAGE OF LEMONT ORDINANCE NO. Q -33-0 AN ORDINANCE GRANTING PRELIMINARY PLAT APPROVAL AND SPECIAL USE FOR A RESIDENTIAL PLANNED UNIT DEVELOPMENT (PUD) ON A .36 ACRE PARCEL LOCATED AT 508 ILLINOIS STREET IN LEMONT, ILLINOIS (CARPEDIEM) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 14TH DAY OF MAY, 2007 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COOK, WILL AND DUPAGE COUNTIES, ILLINOIS, THIS 14TH DAY OF MAY, 2007 1 ORDINANCE NO. /23_12. [ AN ORDINANCE GRANTING PRELIMINARY PLAT APPROVAL AND SPECIAL USE FOR A RESIDENTIAL PLANNED UNIT DEVELOPMENT (PUD) ON A .36 ACRE PARCEL LOCATED AT 508 ILLINOIS STREET IN LEMONT, ILLINOIS (CARPEDIEM) WHEREAS, Anton Maletich of Carpediem Group, LLC, hereinafter referred to as the Petitioner, is the owner of the subject property consisting of .36 acres; said parcel is located at 508 Illinois Street, and is legally described in Exhibit "A" attached; and WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for preliminary plat approval and special use for a planned unit development; and WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on March 6, 2007 and voted 6- 0 with one member absent to recommend approval of the petitioner's request with the finding of facts attached as Exhibit B; and WHEREAS, the petitioner has submitted the Preliminary Plat of Resubdivision for the subject property, attached hereto as Exhibit C, site plan attached hereto as Exhibit D, home elevations, attached hereto as Exhibit E; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Daily Southtown, a newspaper of general circulation within the Village; and WHEREAS, the Preliminary Plat of Subdivision is in substantial conformance with the physical development policies and standards of the Village of Lemont. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND WILL, ILLINOIS: Section 1. Conditions to PUD. A special use for a PUD is granted to allow construction of a residential development at 508 Illinois Street, PIN's 22 -20- 429 -005, 22 -20- 429 -006, 22 -20- 429 -014, 22 -20- 429 -015, with the following conditions: 1. Final Plans shall substantially conform to the PUD Site Plan, prepared by Paul K. Morris, P.E., with a revision date of April 19, 2007, attached as Exhibit D. 2. Building Elevations shall be consistent with the elevations attached as Exhibit E, subject to the conditions issued by the Historic Preservation Commission, attached as Exhibit F. 2 3. Final PUD plans are subject to the Village Engineer's review and approval. 4. The four single family dwelling units shall not be converted to multiple family dwelling units, regardless of the zoning, without approval of the Village Board. 5. The developer shall pay land -cash contributions for schools and parks for the three additional homes prior to final approval of the plat. I. CALL TO ORDER The regular meeting of the Historic Preservation Commission was called to order on April 12, 2007 at 6:33 p.m. by Chairman Barbara Buschman. II. ROLL CALL Commissioners Baldwin, Batistich, Flynn, Schwartz; present. Commissioners Roy and Markiewicz absent. Code Enforcement Officer Ed Buettner was also present. III. APPROVAL OF MINUTES Motion by Mr. Baldwin, seconded by Mr. Batistich, to approve the minutes of the March 8, 2007 regular meeting. Voice vote: all ayes. Motion passed. IV. CHAIRMAN'S REPORT V. PUBLIC HEARINGS A. 12.06 510 Illinois Street PUD Elevations & Materials The hearing was re- convened from the March 8, 2007 meeting. Since formal elevations and sample boards were not available at that meeting, the Commission continued the hearing until the April 12 meeting. Renee Sokolis was present and made the presentation for the petitioner, Carpediem. Complete elevations, floor plans and a site plan for the PUD were presented, along with a sample board with siding, roof shingles and palettes for each house. The floor plans for all houses are the same for all with three stories; two of the houses would have similar exterior features, one fronting on Illinois and one fronting on Porter. The second house on Porter would have a hip roof line, and different exterior features. Although the color elevations called for cedar siding, Ms. Sokolis demonstrated a vinyl siding they are planning to substitute for economic reasons. Carpediem would like to keep the price point under $500,000 and because of maintenance issues, selected the vinyl. On Porter Street they chose the taupe siding for one house and a grey -blue for the second; the Illinois Street house is a beige color called wicker. Wood rails and trim work in white and/or cream will accent the main color. A fiberglass themaproof door is proposed for each house. Discussion centered on the use of vinyl siding for new construction in the historic district. Mr. Flynn stated that although the commission has permitted vinyl in some situations for remodeling, vinyl is not a recommended material for new construction. Mr. Schwartz recommended a dipped cedar siding. Hardie board was also recommended if maintenance is an issue. Mr. Batistich noted the expanse of siding, particularly on the side elevations which would be visible and concurred with the recommendation to use cedar or hardie board. As a compromise, it was suggested that using vinyl on the garages could be an option, since they would not be visible from either street, as long as the vinyl matched the house color and had the same profile as the house siding. The Commission noted the long front porch expanse between columns on the two identical houses, and suggested adding two additional columns for balance and support in the angled space between the bay and mullions which should not impede the view. Chairman Buschman commented that the front setback on Illinois Street is not what the Commission EXHIBIT F would like to see on this block. The minimal side setbacks will crowd the existing houses. A motion was made by Mr. Flynn, seconded by Mr. Batistich to close the public hearing at 7:10 p.m. Mr. Baldwin moved, and Mr. Flynn seconded, to issue a Certificate of Appropriateness with conditions to use cedar siding or hardie board for the exterior siding on the houses with an approval for vinyl siding on garages as long as the color and profile are matched to the house. A second condition is to add two columns to the covered front porch on the identical houses in the spaces between the mullions and the bay front window. Voice vote: all ayes. Motion passed. EXHIBIT F
