Q.35,6)7 AN ORDINANCE GRANTING THE REQUEST FOR A TEMPORARY SPECIAL USE TO ALLOW CONCRETE CRUSHING AND OUTDOOR STORAGE OF EQUIPMENT AT 13453 MAIN STREET IN LEMONT, ILLINOIS (Atrium) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 29TH DAY OF MAY, 2007 Published in pamphlet form by authority of the President and Board of Trustees of the Village of Lemont, Cook, DuPage, and Will Counties, Illinois this 29th day of May, 2007 ORDINANCE NO. 0 • :35;0 7 AN ORDINANCE GRANTING THE REQUEST FOR A TEMPORARY SPECIAL USE TO ALLOW CONCRETE CRUSHING AND OUTDOOR STORAGE OF EQUIPMENT AT 13453 MAIN STREET IN LEMONT, ILLINOIS (Atrium) WHEREAS, Kathleen Bruch, contract purchaser and petitioner, made application for a special use approved to allow concrete crushing and outdoor storage of equipment in a M -3 zoning district, at a property located at 13453 Main Street in Lemont, Illinois, hereinafter referred to as the SUBJECT PROPERTY and described in the attached legal description as "Exhibit A "; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Daily Southtown, a newspaper of general circulation within the Village; and WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois, conducted a Public Hearing on the petition on April 17, 2007 and recommended by a vote of 5 -0 with two members absent to recommend approval of the request; and WHEREAS, the President and Board of Trustees of the Village has reviewed the matter herein and has determined that the same is in the best interest of the Village of Lemont, and herein adopts the finding of facts as set forth by the Planning and Zoning Commission. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: Section 1. Special Use: The passage of this Ordinance shall constitute approval of a special use for the outdoor storage of vehicles and landscape materials and to perform concrete crushing in an M -3 zoning district, at the property commonly known as 13453 Main Street. Section 2. Conditions of approval: The above special uses shall be approved subject to the following condition: 1. The special use for the rock crushing shall be for a maximum of sixteen months from the date of approval. 2. The special use for the outdoor storage of vehicles and landscape materials as the primary use for the property shall be for a maximum of sixteen months from the date of approval. 3. If additional time for either special use is needed then the petitioner shall be required to apply to the Village Board for an extension prior to the expiration of the special use. 4. No additional material shall be allowed to be brought to the site for crushing. The special use for concrete crushing is only for materials existing on the site at the time of approval. 5. In regards to the concrete crushing, only equipment pertinent to the concrete crushing and the removal of the debris shall be kept on the site. 6. In regards to the outdoor storage of vehicles and landscape materials, only the petitioner's vehicles and landscape materials may be stored on the site. 7. Since the outdoor storage of vehicles as a primary use of the property is temporary in nature, the requirement to pave the parking area is waived for the duration of the special use. Once the permanent use is established then all driveways and parking areas will be required to conform to Village standards. 8. Proper screening of all outdoor storage shall be provided. 9. Orange construction fencing shall be required to surround the site during the duration of the rock crushing. SECTION 4. That the Village Clerk of the Village of Lemont be and is directed hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided. SECTION 5. That this Ordinance shall be in full force and effect from and after its passage, approval and publication provided by law.
