O-44-07 06/11/2007VILLAGE OF L ONT ORDINANCE NO. • o 7 AN ORDINANCE GRANTING PRELIMINARY PLAN AND SPECIAL USE FOR A RESIDENTIAL PLANNED UNIT DEVELOPMENT (PUD) AND ZONING MAP AMENDMENT ON 4.62 ACRES LOCATED ON MAIN STREET WEST OF WALKER ROAD (HERITAGE PARK) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 11THDAY OF JUNE, 2007 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COOK, WILL AND DUPAGE COUNTIES, ILLINOIS, THIS 11TH DAY OF JUNE, 2007 ORDINANCE NO.O ' yt4 07 AN ORDINANCE GRANTING PRELIMINARY PLAN AND SPECIAL USE FOR A RESIDENTIAL PLANNED UNIT DEVELOPMENT (PUD) AND ZONING MAP AMENDMENT ON 4.62 ACRES LOCATED AT MAINSTREET WEST OF WALKER ROAD (HERITAGE PARK) WHEREAS, Lemont Properties of Illinois, LLC, hereinafter referred to as "the Petitioner," is the owner of the subject property consisting of 14 parcels covering approximately 4.62 acres, located on Main Street west of Walker Road and legally described in Exhibit "A" attached; and WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for preliminary plat approval, special use for a planned unit development and zoning map amendment to Lemont R -6 Multi- Family Residential District Special Use PUD from Cook County R -4 Single Family Residence District; and WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with Lemont Zoning Ordinance, conducted a public hearing on the petition on November 21, 2005, December 6, 2005, January 17, 2006 and February 21, 2006 and WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois did heretofore commence and conduct a Public Hearing on October 3, 2006, November 14, 2006, and January 16, 2007 and voted 4 -2 with one member absent to not recommend approval of the petitioner's request; and WHEREAS, the findings of fact are attached as Exhibit B; and WHEREAS, the proposal and plan are in substantial conformance with the physical development policies and standards of the Village of Lemont. NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont to approve the Preliminary Plan with zoning map amendment to R -6 Special Use Planned Unit Development with the following conditions: 1. Building exteriors shall comply with the ordinance approving the annexation agreement. 2. Site plan, landscape plan, and engineering plan, and preliminary /final plat shall comply with the ordinance approving the annexation agreement. 3.
