Q , S3 -o 1 AN ORDINANCE GRANTING A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT (PUD) ON A 9.7 ACRE PARCEL, IN THE M -2 DISTRICT (MANUFACTURING DISTRICT), LOCATED AT 13065 MAIN STREET IN LEMONT, ILLINOIS (Lemont Business Park) WHEREAS, Nancy Sertich - Kennedy with Lemont Business Park, L.L.C., hereinafter referred to as "the Petitioner ", is the owner of an approximately 9.7 acre parcel, hereinafter referred to as "the subject property ", located at 13065 Main Street in Lemont, Illinois and described in the attached legal description as Exhibit A; and WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance, Section XVI.G.1 for a Special Use for a Planned Unit Development to develop an office /warehouse complex with self - storage units & an outdoor storage area in the M -2 District; and WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois, in accordance with said Zoning Ordinance, conducted a Public Hearing on the petition on June 19, 2007; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Daily Southtown, a newspaper of general circulation within the Village; and WHEREAS, the Planning and Zoning Commission has recommended approval of the request for a Special Use of a Planned Unit Development by a 6 -0 vote, with one member absent, to the Village Board; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the Special Use for a Planned Unit Development. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: Section 1. Approval of a Special Use for a Planned Unit Development. A Special Use for a Planned Unit Development is approved to allow the construction an office /warehouse complex with self - storage units & an outdoor storage area at 13065 Main Street as described in the attached legal description, Exhibit A subject to the conditions listed in Section 2 of this ordinance. Section 2. Conditions of Approval of a Special Use for a Planned Unit Development. The following conditions apply: 1. No Site Development Permits shall be issued prior to 2. Final Plans shall substantially conform to the Site Plan Exhibit, prepared by C.M. Lavoie & Associates, dated May 11, 2007, which is attached as Exhibit B. 3. Final Architectural Elevations shall be presented to the Village Board for review and approval prior to Final Plat /Plan approval. 4. The Preliminary Engineering Plan, prepared by C.M. Lavoie, revised June 26, 2007 attached as Exhibit C, shall be subject to the Village Engineer's review and approval. Prior to Final Plat /Plan approval the Engineering Plan shall be deemed approved as Final Engineering by the Village Engineer. 5. The Preliminary Landscape Plan, prepared by C.M. Lavoie & Associates, dated May 11, 2007, shall be subject to the Village Arborists review and approval. Prior to Final Plat /Plan approval the Landscape Plan shall be deemed approved as the Final Landscape Plan by the Village Arborist. 6. A continuous 6' wide sidewalk is required along the frontage of Main Street or cash in lieu of such improvement due to the lack of a sidewalk network in the area; 7. The main road serving the parcel will be a private road. 8. The two basins exceed the maximum pond depth of four feet by up to 6 feet. Both will require a waiver from the Village Board from the Standard Specifications Manual and the Village Engineer's recommendation on design. 9. A traffic management plan is required. The management plan shall address aisle widths, turning radii, and on -site directional traffic control signs which are subject to the Village Engineer and Fire Department's review and approval. 10. Lighting to be orientated face down and to the north to avoid glare on adjacent property owners. A photometric plan, along with catalog cuts for lighting fixtures shall be provided. 11. Truck deliveries are prohibited between the hours of midnight to 6 a.m., daily. 12. Access to the self storage units will be allowed only between 6 AM and 9 PM. 13. Current use (truck container storage) on the property will cease upon approval of first building permit.. 14. The property owner shall be required to connect to Village water supply when water main is available. Section 3. A special use for a PUD shall lapse in the event of the following: 1. A complete building permit application has not been received by the Village for such construction, installation, or relocation within one year after the effective date of the ordinance granting said special use; or 2. A building permit has been issued within one year of the effective date of the special use, but such construction, installation or relocation has not commenced within one year after the issuance of the building permit. 3. In the event a special use lapses, nothing herein shall prohibit any person from applying for the same special use or a new special use on substantially the same terms." Section 4. That this ordinance shall be in force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
