AN ORDINANCE GRANTING A VARIATION TO ALLOW A FENCE TO BE
LOCATED IN A FRONT YARD SETBACK AT 11250 SOUTH ARCHER
AVENUE IN LEMONT, ILLINOIS
WHEREAS, Michael A. Lepore of Lifescapes @Montefiori, LLC, hereinafter
referred to as "the Petitioner," is the owner of 11250 South Archer Avenue, hereinafter
referred to as "the subject property," and legally described in Exhibit "A "; and
WHEREAS, the applicant is seeking a variation to the Lemont Zoning Ordinance to
allow a fence to be located in a front yard, pursuant to § V.H.12, §XIV.E.1 and §X1V.F.1 & 3
of the Lemont Zoning Ordinance; and
WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois (the
"Village ") did heretofore commence and conduct a Public Hearing on November 6, 2005 for
approval of the variation; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner
provided by law and was published in the Lemont Reporter /Met a newspaper of general
circulation within the Village; and
WHEREAS, the President and Board of Trustees of the Village have determined that
the best interests of the Village will be served by approving the variation as described herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK,
DUPAGE, AND WILL, ILLINOIS:
SECTION 1. Accessory Use In Required Yard — Fence: A variation is granted to
allow a fence to be located in a front yard as depicted in Exhibit `B ", pursuant to § V.H.12,
§XIV.E.1 and §XIV.F.1 & 3 of the Lemont Zoning Ordinance.
SECTION 2: Condition of Approval: The above variations shall be approved
subject to the following conditions:
1. The variation shall expire after one year from the date of Village Board approval
if at that time the petitioner has not yet applied for and received a building
permit.
2. Gates shall be installed at each entrance along Archer Avenue and along the
Commonwealth Edison right of way.
3. The fence setback from the Archer Avenue right of way shall be a minimum of
50 feet.
4. The fence setback from the Main Street right of way shall be a minimum of 20
feet.
5. A landscape plan showing the landscaping to be installed along the fence shall be
submitted for Community Development review and approval.
