O-10-06 01/23/2006VILLAGE OF LEMONT ORDINANCE NO.) -/0 ` 06 AN ORDINANCE GRANTING THE REQUEST FOR A SPECIAL USE FOR A RESIDENTIAL PLANNED UNIT DEVELOPMENT (PUD) ON A 2.34 ACRE PARCEL LOCATED AT 15266 127TH STREET AND REZONING FROM COOK COUNTY R -4 ZONING (SINGLE FAMILY RESIDENCE DISTRICT) TO R -5 PUD (SINGLE FAMILY ATTACHED RESIDENCE DISTRICT, PLANNED UNIT DEVELOPMENT) IN LEMONT, ILLINOIS (PRAIRIE KNOLLS) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS9th DAY OF JANUARY, 2006 Published in pamphlet form by authority of the President and Board of Trustees of the Village of Lemont, Cook, DuPage, and Will Counties, Illinois this 94 day of January, 2006. ti3 ORDINANCE NO. aid -Q�j AN ORDINANCE GRANTING THE REQUEST FOR A SPECIAL USE FOR A RESIDENTIAL PLANNED UNIT DEVELOPMENT (PUD) ON A 2.34 ACRE PARCEL LOCATED AT 15266 127TH STREET AND REZONING FROM COOK COUNTY R -4 ZONING (SINGLE FAMILY RESIDENCE DISTRICT) TO R -5 PUD (SINGLE FAMILY ATTACHED RESIDENCE DISTRICT, PLANNED UNIT DEVELOPMENT) IN LEMONT, ILLINOIS (PRAIRIE KNOLLS) WHEREAS, Albert Kerelis Jr. with Kerelis, Inc., hereinafter referred to as "the Petitioner ", is the owner of approximately 2.34 acres, hereinafter referred to as "the subject property", PIN #22 -32- 201 -008, in Lemont, Illinois; said parcel is legally described in "Exhibit A" attached to this Ordinance; and WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for a residential planned unit development to rezone the parcel to R -5 PUD Zoning (Single Family Attached Residence Planned Unit Development) from Cook County R -4 Zoning (Single Family Residence District), pursuant under Sections XVI and XVIII I and J; and WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with said Zoning Ordinance, conducted Public Hearings on April 19, May 17, June 21, August 16, September 20 and October 4, 2005 and has recommended approval for said PUD by a vote of 6 -0 to the Village Board; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter Met, a newspaper of general circulation within the Village; and NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont, that the Petitioner, Albert Kerelis Jr. with Kerelis, Inc., be granted the requested single family attached residential plan unit development zoning (R -5 PUD) from Cook County R -4 Zoning (Single Family Residence District). Section 1. A zoning map amendment is granted to allow the change in the zoning classification of the parcel located at 15266 127th Street, (PIN 22 -32- 201 -008) to R -5 PUD Zoning (Single Family Attached Residence Planned Unit Development) from Cook County R -4 Zoning (Single Family Residence District), as illustrated in the Plat of Survey attached as Exhibit `B ". Section 2. As provided in Chapter XVI.H.2. &8. (Special Use — Planned Unit Developments) of the Lemont Zoning Ordinance, the Village has deemed it appropriate to approve the following selected bulk exceptions as part of the Planned Unit Development for Prairie Knolls: a. To reduce the rear yard setback from 30 feet to 24 feet to allow decks. b. To reduce the right of way width from 66 feet to 60 feet. Section 3. The Planned Unit Development approval shall lapse in the event the Petitioner does not file a complete application for a site development permit within one (1) year of the effective date of this ordinance.
