AN ORDINANCE GRANTING VARIATIONS TO SIDE YARD SETBACKS FOR
1406 ROSCOMMON WAY IN LEMONT, ILLINOIS
WHEREAS, Stanley Smagala, hereinafter referred to as "the Petitioners," are the
contract purchasers owners of 12864 Mayfair Drive, hereinafter referred to as "the subject
property," and legally described in Exhibit "A "; and
WHEREAS, the applicant is seeking the following:
• a variation to allow a house to encroach a maximum of three feet into the
required 25 foot side yard setback adjoining a street;
• a variation to allow the house to encroach a maximum of four feet into the
required 15 foot side yard setback
These variations are pursuant to of the Lemont Zoning Ordinance §VII.E.7.(2).(c).
WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois (the
"Village ") did heretofore commence and conduct a Public Hearing on February 7, 2006 for
approval of the variations; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner
provided by law and was published in the Daily Southtown a newspaper of general
circulation within the Village; and
WHEREAS, the President and Board of Trustees of the Village have determined that
the best interests of the Village will be served by approving the variation as described herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK,
DUPAGE, AND WILL, ILLINOIS:
SECTION 1. A variation is granted to allow an encroachment of not more than 3
feet into the required 25 foot setback for the corner of a garage. This area is labeled "A" on
Exhibit B.
SECTION 2. A variation is granted to allow an encroachment of not more than 4
feet into the required 15 foot setback for a 4 x 12.7 bump out . This area is labeled "B" on
Exhibit B.
SECTION 3: Condition of Approval: The above variations shall be approved
subject to the following conditions:
1. The variation shall expire after one year from the date of Village Board approval
if at that time the petitioner has not yet applied for and received a building
permit.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE AND WILL, ILLINOIS,
ON THIS 13th DAY OF FEBRUARY, 2006.
