AN ORDINANCE CREATING THE ZONING COMMISSION
WHEREAS, the Village of Lemont is authorized by the Illinois Municipal Code
to create a zoning commission with the duty to recommend boundaries of districts and
appropriate zoning regulations to be enforced (65 ILCS 5/11- 13 -2); and
WHEREAS, the Village of Lemont Board of Trustees passed Ordinance No. 0-
25 -99 adopting the Zoning Ordinance of Lemont on March 22, 1999; and
WHEREAS, the Village of Lemont Board of Trustees has passed several
amendments to said ordinance since its adoption; and
WHEREAS, the Village of Lemont Board of Trustees now desires to re- evaluate
and update the said ordinance in its entirety, and THEREFORE,
BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF
TRUSTEE OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE,
AND WILL, ILLINOIS:
SECTION 1: Chapter 2.67 of the Lemont Municipal Code is hereby created as
follows:
ZONING COMMISSION
2.67.010 TITLE
The name of this organization is known and cited as the "Lemont Zoning
Commission."
2.67.020 PURPOSE OF THE COMMISSION
The Zoning Commission's charge is to recommend changes to the Lemont
Zoning Ordinance, and to include changes to the text of the ordinance and the
Official Zoning Map of the Village of Lemont.
2.67.040 RESPONSIBILITIES AND POWERS
The Zoning Commission shall have the following responsibilities and powers
under this subchapter:
A. Conduct public meetings to evaluate the current Zoning Ordinance,
propose changes to the Zoning Ordinance, and afford interested persons an
opportunity to be heard.
B. Prepare tentative reports, amendments, and a proposed zoning ordinance
for the entire municipality.
C. After the preparation of such a tentative reports, amendments, and
ordinance, the Commission shall hold a hearing thereon and shall afford
interested persons an opportunity to be heard. Notice of the hearing shall be
published at least once, not more than 30 or less than 15 days before the
hearing, in one or more newspapers published in the Village of Lemont.
D. Within 30 days after the final adjournment of the hearing, the Commission
shall make a final report and submit a proposed ordinance for the entire
municipality to the Village Board. The Village Board may enact the ordinance
with or without change, or may refer it back to the Commission for further
consideration.
2.67.050 COMPOSITION; OFFICERS AND DUTIES
A. Composition. All Commission members are appointed by the Mayor with
the concurrence of the Board of Trustees. The Commission is composed
of five official members, each with an equal vote. The Mayor, with
concurrence of the Village Board of Trustees, may for good cause shown
remove any member of the Commission.
B. Officers and duties. The officers and duties are determined by the Village
Board.
(1) Chairman. The Commission Chair shall be a voting member of the
Commission. The Chair shall preside over all meetings of the
Commission.
(2) Vice - Chairman. In the absence of the Chair, the Vice - Chairman shall
assume his/her duties.
(3) Secretary. The Secretary shall maintain a record of all meetings,
attendance, and items as deemed necessary, and shall perform those
functions as determined by the Chair.
(4) Community Development Department. The Community Development
Director and the staff of the Community Development Department
shall assist the Commission with research, advice, and administrative
support.
C. Meetings. The Commission shall meet as frequently as it deems
necessary, but not less than once every three months. All members of the
Commission are required to attend all regularly scheduled meetings.
(1) Regular meetings. Regular meetings of the Commission shall be held
at such location as designated by the Chair at the prior meeting.
(2) Quorum. A quorum of the Commission shall be comprised of the
majority of voting membership of the Commission. A quorum of the
Commission must be present when voting. Passage of any motion
shall require a simple majority of the quorum so voting.
(3) Meeting procedures. The Commission shall adopt Robert's Rules of
Order, current edition.
2.67.060 DISSOLUTION OF THE COMMISSION
The zoning commission shall cease to exist upon the adoption of a zoning
ordinance for the entire municipality.
SECTION 2: Effective Date: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in a manner provided by law.
SECTION 3: Repeal: All Ordinances or parts of Ordinances in conflict herewith
shall be and the same are hereby repealed.
The Village Clerk of the Village of Lemont shall certify to the adoption of this
Ordinance and cause the same to be published in pamphlet form.

OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DUPAGE,
ILLINOIS on this 13th day of February, 2006.
