ORDINANCE NO. 0 -17-6 e AN ORDINANCE GRANTING THE REQUEST FOR A SPECIAL USE FOR A RESIDENTIAL PLANNED UNIT DEVELOPMENT (PUD) ON A 30 ACRE PARCEL, LOCATED AT 636 FIRST STREET AND REZONING FROM LEMONT R -1 ZONING (SINGLE FAMILY DETACHED RESIDENCE DISTRICT) TO R -5 (SINGLE FAMILY ATTACHED RESIDENCE DISTRICT) IN LEMONT, ILLINOIS (WOODGLEN SUBDIVISION) WHEREAS, Donven Homes, Inc. hereinafter referred to as "the Petitioner ", is the owner of an approximately 30 acre parcel, hereinafter referred to as "the subject property ", located at 636 First Street in Lemont, Illinois. WHEREAS, the Petitioner made application for a special use - residential planned unit development and to rezone the parcel from Lemont R -1 Zoning (Single Family Detached Residence District) to R -5 Zoning (Single Family Attached Residence), pursuant to the Lemont Zoning Ordinance ( §VII.F.1.c, §XVI and §XVIII I and J). WHEREAS, the Plan Commission and the Zoning Board of Appeals met on November 22, 2005 for a joint workshop and discussed recommendations for approval of the single family attached residential plan unit development (R -5 PUD) to the Zoning Board of Appeals; and WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with said Zoning Ordinance, conducted Public Hearings on the petition on November 1, 2005, December 20, 2005, and January 17, 2006 and recommended approval by a vote of 5 -2 to the Village Board; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter Met, a newspaper of general circulation within the Village; and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND WILL, ILLINOIS: Section 1. Approval of a zoning map amendment is granted to allow the change in the zoning classification of the parcel located at 636 First Street from Lemont R -1 Zoning (Single Family Detached Residence District) to R -5 Zoning (Single Family Attached Residence), as illustrated in the Plat of Survey attached as Exhibit "A ". Section 2. Approval of a special use - planned unit development is granted As provided in Lemont Zoning Ordinance, §XVI.H (Special Use - Planned Unit Developments) with the following selected bulk exceptions as part of the Planned Unit Development for Woodglen Subdivision: a. A variation from the Standard Specifications for the Design and Construction of Public Improvements and Private Site Improvements requirement of a 66 -foot of right -of -way for roadways, to a 60 -foot right -of -way; and b. A variation from the Standard Specifications for the Design and Construction of Public Improvements and Private Site Improvements requirement for a maximum high -water depth for detention ponds of four feet to allow a high -water depth of six feet; and c. The Landscape Plan, as prepared by Wehler Peterson & Associates and dated January 5, 2006, shall incorporate the comments contained in the letter from Urban Forest Management, LTD., dated January 17, 2006; and d. A Tree Preservation Plan shall be submitted indicating trees for removal and preservation; and e. The Engineering Plans shall be revised to incorporate the comments from Jim Cainkar dated January 16, 2006. Section 3. The Planned Unit Development approval shall lapse in the event the Petitioner does not file a complete application for a site development permit within one (1) year of the effective date of this AGREEMENT.
