AN ORDINANCE GRANTING THE REQUEST FOR A SPECIAL USE FOR A NON - ELECTRONIC CHANGEABLE COPY SIGN AT 1276 STATE STREET IN LEMONT, ILLINOIS (Burger King) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 27TH DAY OF MARCH, 2006 Published in pamphlet form by authority of the President and Board of Trustees of the Village of Lemont, Cook, DuPage, and Will Counties, Illinois this 27th day of March, 2006 7 ORDINANCE NO .O__!3- -D(p AN ORDINANCE GRANTING THE REQUEST FOR A SPECIAL USE FOR A NON - ELECTRONIC CHANGEABLE COPY SIGN AT 1276 STATE STREET IN LEMONT, ILLINOIS (Burger King) WHEREAS, Adam Velarde, a francisee of Burger King Corporation, hereinafter referred to as the Petitioner, is the owner of property at 1276 State Street in Lemont, Illinois, hereinafter referred to as the subject property, and described in the attached legal description as Exhibit "A "; and WHEREAS, the Petitioner made application under the provisions of §XV.F.7.a -g and §XVIII.J of the Lemont Zoning Ordinance for a special use to allow a non - electronic changeable copy sign at 1276 State Street in Lemont, Illinois; and WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with said Zoning Ordinance, conducted a Public Hearing on the petition on February 21, 2006 and March 7, 2006; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter/Met, a newspaper of general circulation within the Village; and WHEREAS, the Zoning Board of Appeals has recommended approval of the request for a special use to the Village Board; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the special use by the standards of the Special Use Procedures, §XVIII.J of the Lemont Zoning Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: Section 1. Special Use: A special use is granted to allow a non - electronic changeable copy sign at 1276 State Street in Lemont, Illinois, pursuant to §XV.F.7.a -g and § XVIII.J of the Lemont Zoning Ordinance. Section 2. Conditions. The following conditions shall apply: 1. Prior to the issuance of a building permit a landscape plan must be submitted to the Community Development Department for review and approval. 2. The 8' x 8' faces of the sign must comply with the current Zoning Ordinance 8 regulation that no internally illuminated sign shall have a translucent background; only the sign message shall permit transmission of any light through the sign face. 3. No more than three lines of changeable copy shall be allowed. 4. Additional signage, including but not limited to banners, shall be prohibited from being attached to the monument sign. All other temporary signs shall conform to the Lemont Zoning Ordinance, Section XV.B. 5. The bottom of the non - electronic message center shall be a minimum of 1' — 9" from grade to allow for landscaping. 6. Exhibit `B" shall be revised to include a minimum of eight inches of brick above the sign face and a decorative limestone cap. 7. Prior to the issuance of a building permit an architectural drawing must be submitted to the Community Development Department for review and approval. Section 3. That this ordinance shall be in force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
