AN ORDINANCE GRANTING THE REQUEST FOR A SPECIAL USE FOR
OUTDOOR STORAGE AND TRANSSHIPMENT OF WATER -BORNE
BULK MATERIALS AT 16700 DES PLAINES RIVER ROAD IN LEMONT,
ILLINOIS

WHEREAS, American River Transportation Company, hereinafter referred to as the
Petitioner, is the lessee of property owned by The Metropolitan Water Reclamation District of
Greater Chicago (MWRD), hereinafter referred to as the subject property, located at 16700 Des
Plaines River Road in Lemont, Illinois and described in the attached legal description as Exhibit A;
and
WHEREAS, the Petitioner made application under the provisions of §VIII.F.2.c & § XVIII.J
and §XVIII.K.4 in the Lemont Zoning Ordinance for a special use to allow the outdoor storage and
transshipment of water -borne bulk materials at 16700 Des Plaines River Road in Lemont, Illinois;
and
WHEREAS, the Petitioner has provided a letter from the MWRD, dated January 11, 2006,
attached as Exhibit B, showing that the MWRD is aware of the petitioner's request for special use
and that the special use request is an allowed use per the lease on the property; and
WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance
with said Zoning Ordinance, conducted a Public Hearing on the petition on March 7, 2006; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by
law and was published in the Lemont Reporter /Met, a newspaper of general circulation within the
Village; and
WHEREAS, the Zoning Board of Appeals has recommended approval of the request for a
special use to the Village Board; and
WHEREAS, the President and Board of Trustees of the Village have determined that the
best interests of the Village will be served by approving the Special Use by the standards of the
Special Use Procedures, §XVIII.J of the Lemont Zoning Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:
Section 1. Special Use: A special use is granted to allow outdoor storage and transshipment
of water -borne bulk materials, pursuant to §VIII.F.2.c & § XVIII.J and §XVIII.K.4 of the Lemont
Zoning Ordinance.

Section 2. Conditions. The following conditions shall apply:
1. No bulk material stockpile shall exceed a height of twenty (20) feet and shall
otherwise comply in full with the standards of Chapter 8.33 of the Lemont
Municipal Code.
2. No materials other than sand or aggragate shall be stockpiled in the locations
indicated on Exhibit C.
Section 3. That this ordinance shall be in force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DU PAGE,
ILLINOIS, on this 27th day of March, 2006.
