O-25-06 05/08/2006VILLAGE OF LElyIONT ORDINANCE NO. 0 a5,067 AN ORDINANCE GRANTING VARIATIONS FROM THE STANDARD SPECIFICATIONS FOR THE DESIGN AND CONSTRUCTION OF PUBLIC IMPROVEMENTS AND PRIVATE SITE IMPROVEMENTS FOR 11S377 LEMONT ROAD IN LEMONT, ILLINOIS APPROVED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 8TH DAY OF MAY , 2006 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DUPAGE, ILLINOIS, THIS 8TH DAY OF MAY, 2006 ORDINANCE NO. o?1/45--06 AN ORDINANCE GRANTING VARIATIONS FROM THE STANDARD SPECIFICATIONS FOR THE DESIGN AND CONSTRUCTION OF PUBLIC IMPROVEMENTS AND PRIVATE SITE IMPROVEMENTS FOR 11S377 LEMONT ROAD IN LEMONT, ILLINOIS WHEREAS, Al Malley, hereinafter referred to as "the Petitioner ", acting on behalf of the owner of a parcel at 11S377 Lemont Road in Lemont, Illinois, hereinafter referred to as "the subject property", PIN # 10 -08- 105 -008 in Lemont, Illinois; said parcel is legally described in "Exhibit A" attached to this Ordinance; and WHEREAS, the applicant is seeking a variation from The Standard Specifications for the Design and Construction of Public Improvements and Private Site Improvements, §4.01.A Water Supply and §7.02.A.1 ; and WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on April 4, 2006 for approval of the variations; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Daily Southtown a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the variation as described herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND WILL, ILLINOIS: SECTION 1: A variation is granted to allow the two lot subdivision not to connect to the Village water distribution system. SECTION 2: A variation is granted to Village of Lemont Standards, part 7.02 to allow this development to have no on -site storm water detention. SECTION 3: Condition of Approval: The above variations shall be approved subject to the following conditions: 1. The variation shall expire after one year from the date of Village Board approval if at that time the petitioner has not yet applied for and received a building permit.
