ORDINANCE NO. 0 - ae -OGr AN ORDINANCE APPROVING VARIATIONS FOR CONSTRUCTION OF A DETACHED GARAGE AT 613 SINGER AVENUE IN LEMONT, ILLINOIS WHEREAS, Michael Subka, hereinafter referred to as "the Petitioner," is the owner of a 5,967 square foot parcel, hereinafter referred to as "the subject property," located at 613 Singer Avenue in Lemont, Illinois and legally described in Exhibit "A "; and WHEREAS, the applicant is seeking variations to the Lemont Zoning Ordinance, §VII.E.10.d.4 to allow a detached garage to exceed 10% of the 15% impervious allowance of the total lot area, Lemont Zoning Ordinance §VII.E.10.d.5 to allow a detached garage to be nearer than five feet to the rear and side property lines and Lemont Zoning Ordinance §VILE.10.e.2 to allow a driveway to exceed the 5% of the 15% impervious allowance of the total lot area; and WHEREAS, the Plan Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on April 25, 2006 for approval of the variation; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Daily Southtown a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the variation as described herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: Section 1. Detached Garage Lot Coverage: A variation is granted to increase the maximum impervious surface allowance for a detached garage from 10% of the total lot area (596.7 square feet) to 11.27% (672 square feet), pursuant to the Lemont Zoning Ordinance ( §VII.E.10.d.4); and Section 2. Setbacks: A variation is granted to reduce the setbacks from the side and rear lot lines from five feet to 1.5 feet for the north property line and one inch for the east property line, pursuant to the Lemont Zoning Ordinance ( §VII.E.10.d.5); and Section 3. Driveways: A variation is granted to increase the maximum impervious surface allowance for a driveway from 5% (298.35 square feet) to 6.8% (405 square feet); and Section 4. Conditions of Approval: The above variations shall be approved subject to the following conditions: 5 1. The 430 square feet of impervious surface that is in excess of the maximum 15% allowed shall be allowed as bonus impervious surface. 2. No additional impervious surface shall be allowed. 3. The variation shall expire after one year from the date of Village Board approval if at that time the petitioner has not yet applied for and received a building permit. I. CALL TO ORDER The regular meeting of the Historic Preservation Commission was called to order on March 9, 2006 at 6:30 p.m. by Chairman Barbara Buschman. II. ROLL CALL Commissioners Buschman, Baldwin. Batistich, Flynn, Markiewicz, Roy, and Schwartz; present. Jim Brown, Community Development Director, was not able to attend. III. APPROVAL OF MINUTES Motion by Mr. Markiewicz, seconded by Mr. Flynn, to approve the minutes of the regular meeting of February 9, 2005. Voice vote: 7 ayes. Motion passed. IV. CHAIRMAN'S REPORT V. APPLICATION REVIEWS A. 03.06 613 Singer Avenue Demolition and New Construction - Garage The petitioner, Michael Subka, presented an application for demolition of an existing one car garage at 613 Singer Avenue, and construction of a 24 x 28' SUV garage with a 9' door and 10' ceiling height. Correspondence included in the packet from Peter Krumins, Village Planner, states that the garage as presented would require a variation from the Zoning Ordinance for lot area coverage and setback requirements (Plan Commission would review). The Commission reviewed the drawing submitted which was a standard frame garage. Siding material is to be the same as the house with white doors and trim. Mr. Flynn presented a sketch, adding a frieze board, brackets, a center vent as is present on the house, and coach lights flanking the garage door to provide some complimentary details to the garage. Mr. Batistich pointed out the three most important features for the new construction: 1) match the pitch of the roof to the pitch of the primary house roof; 2) match the roof shingles to the house shingles; 3) match the siding to the house siding. Motion by Mr. Flynn, seconded by Ms. Roy, to authorize execution of a Certificate of Appropriateness for construction of a 24 x 28' garage pursuant to review by the Plan Commission, per drawings submitted 3/9/06 and including the Commissions recommendations for additional details and lighting. Voice vote: 7 ayes. Motion passed. B. 04.06 502 Singer Avenue Shed demolition; fence, removal of lattice and painting of deck; addition of shutters and flower boxes to windows. The Petitioners, Eric and Katie Brosseau, submitted an application to demolish a shed, add a wood picket fence in the rear yard, remove lattice on the front deck; paint front and back deck white, add window shutters and flower boxes to front 5 windows. Mr. Markiewicz did a visual inspection of the site prior to the meeting and reported that the existing shed is in poor condition and should be demolished.
