O-32-06 06/12/2006VILLAGE OF LEMONT ORDINANCE NO. 0 -32 -06 AN ORDINANCE REQUIRING COMMONWEALTH EDISON TO PERFORM NON - STANDARD CONSTRUCTION WORK (Overhead Lines at Front & River Street) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT This 12th day of June , 2006 Published in pamphlet form by authority of the President and Board of Trustees of the Village of Lemont, Counties of Cook, Will, and DuPage, Illinois this 12th day of June ,2006 ORDINANCE REQUIRING COMMONWEALTH EDISON TO PERFORM NON - STANDARD CONSTRUCTION WORK (Overhead lines at Front & River Streets) WHEREAS, under Rider 28 as approved by the Illinois Commerce Commission, Commonwealth Edison is permitted to recover the cost of complying with non - standard requirements imposed by municipalities; and WHEREAS, the undergrounding of Commonwealth Edison's distribution lines located within the rights -of -way of Front & River Streets, as shown on the Lemont "Overhead to Underground Sketch ", prepared by Commonwealth Edison attached hereto as Exhibit 1 and made a part hereof, is a non - standard municipal requirement; and WHEREAS, the corporate authorities of the Village desire to require Commonwealth Edison to place its existing distribution wires underground within the rights -of -way as shown on the "Overhead to Underground Sketch"; provided, however, that Commonwealth Edison recover the cost of placing the wires underground in the following manner: the cost of the underground wiring identified on the "Overhead to Underground Sketch" shall be recovered by Commonwealth Edison under Rider 28; and WHEREAS, the specific Commonwealth Edison distribution wires which are to be placed underground are depicted in the "Overhead to Underground Sketch "; NOW, THEREFORE, BE IT ORDAINED by the corporate authorities of the Village of Lemont, Cook, Will and DuPage Counties, Illinois, as follows: SECTION ONE: The recitals set forth hereinabove shall be and are hereby adopted as findings as if said recitals were fully set forth within this Section One. SECTION TWO: Commonwealth Edison shall be and is hereby required to place underground all of its distribution wires, located within the rights -of -way, which are not already below ground, as shown on the "Overhead to Underground Sketch "; SECTION THREE: The Mayor and Board of Trustees hereby approve the Customer work Agreements attached hereto as Exhibit 2 and made a part hereof, and the Mayor shall be and is hereby authorized and directed to execute said Customer Work Agreements in substantially the form attached hereto. SECTION FOUR: Any policy, resolution or ordinance of the Village which conflicts with the provisions of this ordinance shall, to the extent of such conflict, be repealed. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law. PIAZZA, Villa td"-sident PL 475203 CWA # PM06 R:0 Date: 05/03/2006 Customer Work Agreement The Village of Lemont ( "Customer"), a local governmental unit, and Commonwealth Edison Company ( "Company') agree that the Company will furnish at the Customer's expense the labor and materials necessary to install non - standard facilities as required by the Customer in and adjacent to the Front & River Street right of way in the Village of Lemont described below. In General, the work will include replacing the overhead electric 12 &34 kV distribution facilities consisting of approximately 14 poles, 3 transformer banks, wire and other related equipment with an underground distribution system. The new underground equipment will include approximately 2,000' of primary underground cable, 4 cable poles, 2 pad- mounted switchgears, 3 pad- mounted transformers and other related equipment. Customer will fumish and install 6" PVC with pull rope. AT &T will complete removal of joint ownership poles, pursuant to parity conditions at the time the work is actually performed. The Customer shall coordinate the revision of and transfer of other customer services that are affected by the relocation of the overhead distribution facilities. Customer shall provide easements for placement of the underground electric distribution facilities. The Customer agrees to pay to the Company the sum of $ 354,975.92 payment in full due prior to beginning of Company work. The total of the charges due shall be based on actual costs to the Company. In the event of any changes in the scope of the project, which result in additional charges, a new cost estimate of such additional charges and the Company, for Customer review, will provide a new payment schedule. This agreement is contingent upon the Company receiving all necessary permits and easements to perform the work. This Agreement does not waive or alter any of ComEd's rates, riders, or terms and conditions of service. The project sketch dated 05/03/2006 and attached hereto is hereby made a part of this Agreement. The charges reflect only the work performed by the Company. There may be additional costs required by other utility or communication companies. They should be contacted for their associated charges. Work will be done during the Company's regular working hours, unless otherwise specified. All Facilities and equipment installed in conjunction with this work shall in all cases remain the property of the Company. In the event the work covered by this Agreement cannot be completed within one year from the above date as a result of delays on the part of the Customer or because the Company has been denied access to the premises, the charge to the Customer shall be recomputed based on the level of costs prevailing at the time of completion of the work as stipulated in the Company's General Company Order No. 25. This Agreement is subject to the provisions of the Company's Schedule of rates and Information and Requirements for the Supply of Electric Service.
