AN ORDINANCE AMENDING THE SPECIAL USE FOR A RESIDENTIAL PLANNED
UNIT DEVELOPMENT (PUD) AND VARIATIONS TO A DEVELOPMENT
GENERALLY LOCATED AT THE CORNER OF MAIN STREET AND A SOUTHEAST
EXTENSION OF TALCOTT AENUE IN LEMONT, ILLINOIS
WHEREAS, Bill O'Malley, New Market Development, Inc., petitioned for a
request for a special use for a residential planned unit development (PUD) on a 5.3-
acre parcel as well as variations; and,
WHEREAS, this 5.3 -acre parcel was duly described in Exhibit "A" of Ordinance
0 -67 -02 (hereinafter referred to as the "TERRITORY "); and
WHEREAS, these requests for the TERRITORY were approved and adopted by
the President and the Board of Trustees o the Village of Lemont on November 25, 2002
in Ordinance 0- 67 -02; and
WHEREAS, Bill O'Malley, having initiated and/or completed various approval
conditions listed in Section 1 of Ordinance 0 -67 -02 and now wishing to transfer his
development rights to Lennar Communities of Chicago, LLC; and
WHEREAS, Lennar Communities of Chicago, LLC (hereinafter referred to as the
"DEVELOPER ") has submitted development plans that differ from those approved as
Exhibit "B" to Ordinance 0- 67 -02, and that these plans submitted by the DEVELOPER
are attached hereto as Exhibit "A "; and
WHEREAS, the President and Board of Trustees have reviewed these plans
submitted by the DEVELOPER and find that they do not substantially alter the site plan,
engineering, landscaping, building materials, building height, and residential density of
the plans approved as Exhibit B to Ordinance 0- 67 -02;
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Lemont, Counties of Cook, DuPage, and Will, State of Illinois,
that Ordinance 0 -67 -02 is hereby amended to grant Lennar Communities of Chicago,
LLC the authority to develop the TERRITORY in accordance with the plans described in
Section 2 of this ordinance and hereto attached as Exhibit "A ".

Section 1. Conditions of Approval. The following conditions of approval shall
1. The DEVELOPER assumes all responsibilities as outlined in Section 1 of
Ordinance 0- 67 -02; and
2. The final engineering plans shall be approved by the Village Engineer;
and
3. The DEVELOPER shall submit plans for all applicable building permits for
review and approval to the Community Development Department and pay
all fees associated with plan review and permitting.
Section 2. Exhibit "A ". The following plans and documents, hereto attached,
comprise Exhibit "A ":
1. Overall Landscape Plan by Olson Design Group LLC, 3 sheets, dated
7/31/06, 3 sheets;
2. Engineering Improvement Plans for Singer Landing by P &D Consultants, 11
sheets, dated 7/30/06;
3. Character Elevations by Bloodgood Sharp Buster, 2 sheets showing front,
side, and rear elevations, dated July 12, 2006 and revised July 18, 2006
4. List of exterior building materials prepared by Lennar, dated 7/27/06

OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DU PAGE,
ILLINOIS, on this 14th day of August, 2006.
