ORDINANCE NO.IJ 5M6 AN ORDINANCE AMENDING A VARIATION TO ALLOW A FENCE TO BE LOCATED IN A FRONT YARD SETBACK AT 12864 MAYFAIR DRIVE IN LEMONT, ILLINOIS WHEREAS, The President and Board of Trustees granted Dennis McCaffrey and Lori McCaffrey, hereinafter referred to as "the Petitioners," a variation to allow a fence located in a front yard set back at 12864 Mayfair Drive; and WHEREAS, this variation was granted in Ordinance 0 -93 -05 on November 28, 2005; and WHEREAS, Section 3 of Ordinance 0 -93 -05 described the conditions of approval for this variation NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont, Counties of Cook, DuPage, and Will, in the State of Illinois, that Ordinance 0 -93 -05 by amended as follows: Section 3, Number 3 be changed from "The fence shall be wrought iron with landscaping around it" to read "The fence shall be a decorative metal fence with landscaping around it." Y.LP < 5 AN ORDINANCE GRANTING A VARIATION TO ALLOW A PRIVATE SWIMMING POOL TO BE LOCATED IN A SIDE YARD AND TO ALLOW A FENCE TO BE LOCATED IN A FRONT YARD SETBACK AT 12864 MAYFAIR DRIVE IN LEMONT, ILLINOIS WHEREAS, Dennis McCaffrey and Lori McCaffrey, hereinafter referred to as "the Petitioners," are the contract purchasers owners of 12864 Mayfair Drive, hereinafter referred to as "the subject property," and legally described in Exhibit "A "; and WHEREAS, the applicant is seeking a variation to the Lemont Zoning Ordinance to allow a private swimming pool to be located in a side yard and to allow a fence to be located 18 feet into a front yard, pursuant to § V.H.30 and § V.H.12 of the Lemont Zoning Ordinance; and WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on November 22, 2005 for approval of the variations; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter /Met a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the variation as described herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND WILL, ILLINOIS: SECTION 1. Accessory Use In Required Yard — Swimming Pool: A variation is granted to allow a private swimming pool to be located in a side yard pursuant to § V.H.30 of the Lemont Zoning Ordinance. SECTION 2. Accessory Use In Required Yard — Fence: A variation is granted to allow a fence to be located 18 feet in a front yard pursuant to § V.H.12 of the Lemont Zoning Ordinance. SECTION 3: Condition of Approval: The above variations shall be approved subject to the following conditions: 1. The variation shall expire after one year from the date of Village Board approval if at that time the petitioner has not yet applied for and received a building permit. 2. The swimming pool and fence variation shall be for the swimming pool and fence that is installed within one year of the issuance of building permits. 3. The fence shall be wrought iron with landscaping around it. The landscaping is subject to Community Development Department review and approval. 4. The location of the pool and fence shall be consistent with Exhibit B.
