O-57-06 08/28/2006ORDINANCE NO. b"57 -06 AN ORDINANCE GRANTING PRELIMINARY PLAT OF SUBDIVISION AND ZONING MAP AMENDMENT FOR APPROXIMATELY 14.16 ACRE PARCEL LOCATED AT 120 -130 NEW AVENUE (SERENITY COVE) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 28TH DAY OF AUGUST, 2006 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COOK, WILL AND DUPAGE COUNTIES, ILLINOIS, THIS 28TH DAY OF AUGUST, 2006 ORDINANCE NO. D- 5'7 - 062 AN ORDINANCE GRANTING PRELIMINARY PLAT OF SUBDIVISION AND ZONING MAP AMENDMENT FOR APPROXIMATELY 14.16 ACRE PARCEL LOCATED AT 120 -130 NEW AVENUE (SERENITY COVE) WHEREAS, Thomas M. Rediehs, not individually but as Trustee of the Thomas W. Rediehs Family Trust dated January 10, 2002, hereinafter referred to as the PETITIONER, is requesting approval of a Preliminary Plat of Subdivision for the property consisting of 14.16 acres located at 120 -130 New Avenue, and is legally described in Exhibit A and depicted on Exhibit B; and WHEREAS, the petitioner is also requesting approval of a Zoning Map Amendment from Cook County R -4 Single - family Residence District to Lemont R -4 Single - family Detached Residence; and WHEREAS, the petitioner is also requesting approval of a variation from §VII.E.7.a.(3) of the Lemont Zoning Ordinance, §2.01.B of the Standard Specifications for Design and Construction of Public Improvements and Private Site Improvements and §7.02.A.9 of the Standard Specifications for Design and Construction of Public Improvements and Private Site Improvements; and WHEREAS, the Plan Commission met on June 13, 2006 and has recommended approval of the petitioner's request to the Village Board; and WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with Lemont Zoning Ordinance, conducted a Public Hearing on the petition on June 20, 2006, and then the Planning and Zoning Commission continued the Public Hearing on July 11, 2006; and WHEREAS, at the Public Hearing of September 6, 2005 meeting, the Planning and Zoning Commission voted 7 -0 on a recommendation for approval; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter/Met, a newspaper of general circulation within the Village; and WHEREAS, the Village Board has determined that the Preliminary Plat of Subdivision, zoning map amendment to R -4 Single - family Detached Residence and requested variations are in substantial conformance with the physical development policies and standards of the Village of Lemont; and NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DUPAGE, ILLINOIS as follows: SECTION 1: The Preliminary Plat of Subdivision for Serenity Cove, as prepared by Engineering Resource Associated, Inc, revision date of July 28, 2006, attached to this Ordinance as Exhibit C, is hereby approved. SECTION 2: A variation from §VII.E.7.a.(3) of the Lemont Zoning Ordinance (Yard Requirements) to allow for a ten foot reduction from 30 -feet to 20 -feet in the required rear yard setback for Lot 1, as shown on Exhibit C, is hereby granted. SECTION 3: A variation from §2.01.B of the Standard Specifications for Design and Construction of Public Improvements and Private Site Improvements (Streets and Alleys) to allow for a six foot reduction in the dedicated street right -of -way for Serenity Cove Court from 66 -feet to 60 -feet is hereby granted. SECTION 4: A variation from §7.02.A.9 of the Standard Specifications for Design and Construction of Public Improvements and Private Site Improvements (Storm water Management and Storm Sewer) to allow for a one foot increase in the storm water detention ponds maximum elevation between normal water level and high water level from four feet to a maximum of five feet is hereby granted. SECTION 6: Approval of Final Plat of Subdivision will be subject to the following Conditions: 1. A tree survey, tree inventory and tree preservation plan shall be submitted by owner and reviewed and approved by the Village's consulting arborist or Community Development Department. 2. A landscape plan for the residential portion of the territory shall be submitted by owner and reviewed and approved by the village's consulting arborist or Community Development Department. 3. Final Engineering Plans shall be submitted by owner and reviewed and approved by the Village's Engineer. 4. Land/Cash contributions for the School District's, Park District, Lemont Fire Protection District and Lemont Library District shall be paid. 5. A Water System Improvement contribution shall be paid.
