O-60-06 08/28/2006ti ORDINANCE NOD -0 aO AN ORDINANCE GRANTING A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT, PRELIMINARY SITE PLAN APPROVAL, AND ZONING MAP AMENDMENT FOR APPROXIMATELY 3.04 ACRES OF THE 4.81 ACRES LOCATED AT 12420 ARCHER AVENUE AND 12490 WARNER AVENUE (ATLANTIS BANQUET CENTER) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 28TH DAY OF AUGUST, 2006 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COOK, WILL AND DUPAGE COUNTIES, ILLINOIS, THIS 28TH DAY OF AUGUST, 2006 ORDINANCE NO. 0 'to (7 -c: , AN ORDINANCE GRANTING A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT, PRELIMINARY SITE PLAN APPROVAL, AND ZONING MAP AMENDMENT FOR APPROXIMATELY 3.04 ACRES OF THE 4.81 ACRES LOCATED AT 12420 ARCHER AVENUE AND 12490 WARNER AVENUE (ATLANTIS BANQUET CENTER) WHEREAS, Stanley Bafia, owner of the subject property, hereinafter referred to as the petitioner, is requesting approval of a Special Use for a Planned Unit Development for the property consisting of 4.81 acres located at 12416 and 12420 Archer Avenue and 12490 Warner Avenue, and is legally described in Exhibit A and depicted on Exhibit B; and WHEREAS, the Petitioner is requesting approval of a Preliminary Site Plan; and WHEREAS, the petitioner is also requesting approval of a Zoning Map Amendment from Cook County R -3 Single - family Residence District to Lemont B -3 Arterial Commercial for 3.04 acres of the 4.81 acre total; and WHEREAS, the petitioner is also requesting approval of two a variations from §XII.H.2 of the Lemont Zoning Ordinance; and WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with Lemont Zoning Ordinance, conducted a Public Hearing on the petition on October 18, 2005, continued to November 15, 2005, continued to December 20, 2005, continued to January 17, 2006, continued to February 7, 2006, continued to March 7, 2006, continued to March 21 and continued to April 4, 2006; and WHEREAS, at the Public Hearing of April 4, 2006 meeting, the Zoning Board of Appeals voted 3 -2 with two absent on a recommendation for approval; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Daily Southtown, a newspaper of general circulation within the Village; and WHEREAS, the Village Board has determined that the Special Use for a Planned Unit Development, Preliminary Site Plan zoning map amendment to B -3 Single - family Detached Residence and requested variations are in substantial conformance with the physical development policies and standards of the Village of Lemont; and NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DUPAGE, ILLINOIS as follows: SECTION 1: The Preliminary Site Plan for Atlantis Banquet Hall, as prepared by H.E. Miller, Architect, dated December 1, 2004 with a revision date of April 15, 2006, attached to this Ordinance as Exhibit C, is hereby approved with the following conditions: 1. The parking space immediately to the brick fenced refuse enclosure, behind the strip mall, shall be eliminated and additional landscaping shall be installed. SECTION 2: The Special Use for a Planned Unit Development is hereby approved with the following conditions: 1. The buildings shall be constructed with reddish face brick, off -white stone and limestone consistent with the architectural elevations prepared by H.E. Miller, Architect, attached as Exhibits D and E. These materials shall be consistent with the materials identified in Exhibit F and with the material samples provided by the petitioner and maintained in the offices of the Community Development Department. The material samples are identified as Exhibit G. 2. The monument sign shall be built consistent with the ground sign elevation prepared by H.E. Miller, Architect, attached as Exhibit H. 3. The fountain shall be built consistent with the color elevation provided by the petitioner and identified as Exhibit I. 4. Landscaping shall be done consistent with the Landscape Plan as prepared by Susan Kill Kegan & Associates, dated October 29, 2005, attached as Exhibit J. Comments from the Village Arborist shall be incorporated into the Landscape Plan when necessary. SECTION 3: A variation from §XII.H.2 of the Lemont Zoning Ordinance to allow a minimum landscape width of three feet instead of the ten feet required for the drive aisle and garbage dumpster enclosure along the east property line and another variation to §XII.H.2 of the Lemont Zoning Ordinance to allow a minimum landscape width of zero feet instead of the required ten feet for the property line behind the banquet facility, as shown on Exhibit C, is hereby granted. SECTION 7: Approval of Final Site Plan and Final Plat of Subdivision will be subject to the following Conditions: 1. A tree survey, tree inventory and tree preservation plan shall be submitted by owner and reviewed and approved by the Village's consulting arborist or Community Development Department. 2. A landscape plan shall be submitted by owner and reviewed and approved by the village's consulting arborist or Community Development Department. 3. Final Engineering Plans shall be submitted by owner and reviewed and approved by the Village's Engineer. CALL TO ORDER Mayor Piazza called the meeting to order at 7:01 p.m. and acknowledged that the following were present: Trustees Debbie Blatzer, Peter Coules, Brian Reaves, Cliff Miklos, Ron Stapleton and Jeanette Virgilio. Also present were Village staff members Gary Holmes, Tim Schloneger, James Brown, George Schafer and Peter Krumins. DISCUSSION ITEMS Atlantis Banquet Hall PUD The petitioner is requesting approval of annexation, rezoning to Lemont B -3 PUD, special use planned unit development and preliminary plan approval. Staff is recommending approval with several conditions. The ZBA voted 3 -2 in favor of the proposal, with 2 absent. The proposal is consistent with the 2002 Comprehensive Plan. No immediate neighbors came to the public hearing. The Traffic study has been completed. The proposal has 223 parking spaces. IDOT will require a turn lane. Access will be off of Archer Avenue. There is currently no frontage on McCarthy. Trustee Stapleton noted that the plan currently calls for seeding the detention basin. The Village requires sod. The Petitioner stated that they may work with the adjacent property owner for detention. The Petitioner stated that assuming approval, they would expect to start major construction next year. Singer Landing Alternate Construction Proposal Lennar Communities of Chicago, LLC is interested in assuming the role of developer of Singer's Landing. Currently the property has the road improvements and detention in place. Currently the project is approved for 48 condo units. Lennar proposed 2 different options. One option is to have 42 town house units. The other option is to have 12 condo units and 30 town house units. Both of Lennar's proposals would reduce the density, and reduce the height of the project. The petitioner stated that the townhouse buildings are about 1 -full story shorter than the condo buildings.
