AN AMENDMENT TO ORDINANCE 0 -70 -03 REZONING 17.5 ACRES OF
PROPERTY LOCATED AT 13640 - 13670 MCCARTHY ROAD FROM VILLAGE
OF LEMONT R -1 AND COOK COUNTY R -4 TO LEMONT R -4 AND R -5, AND
GRANTING SPECIAL USE FOR A RESIDENTIAL PLANNED UNIT
DEVELOPMENT IN LEMONT, ILLINOIS
WHEREAS, The President and Board of Trustees granted Paul Klabacha, Clayback
Development, LLC„ hereinafter referred to as "the Petitioners," a special use for a planned
unit development; and
WHEREAS, this special use for a planned unit development was granted in
Ordinance 0 -70 -03 on October 27, 2003; and
WHEREAS, Section 2 of Ordinance 0 -70 -03 described the variations from Village
Ordinances that are approved as part of the planned unit development;
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees
of the Village of Lemont, Counties of Cook, DuPage, and Will, in the State of Illinois, that
Ordinance 0- 70 -03, Section 2 be amended with the following variation added to the four
variations already listed:
e. Decorative light standards (pole and luminaire) shall be permitted with the
following conditions:
1. The Village Engineer shall approve of the decorative light standards (pole and
luminaire).
2. The Village Engineer shall approve the photometric plan for the decorative light
standards (pole and luminaire).
3. The developer shall provide the Lemont Public Works Department with additional
poles and luminaries in a number as prescribed by the Lemont Public Works
Department.

AN ORDINANCE REZONING 17.5 ACRES OF PROPERTY
LOCATED AT 13640 -13670 MCCARTHY ROAD FROM VILLAGE
OF LEMONT R -1 AND COOK COUNTY R-4 TO LEMONT R -4 AND R -5, AND
GRANTING SPECIAL USE FOR A RESIDENTIAL PLANNED UNIT DEVELOPMENT
WHEREAS, Paul Klabacha, Clayback Development, LLC, hereinafter referred to as "the
Petitioner ", is the owner of an approximately 17.5 acre parcel, hereinafter referred to as "the
subject property ", located at 13640 to 13670 McCarthy Road in Lemont, Illinois and legally
described on Exhibit "A ".
WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning
Ordinance for a residential planned unit development to rezone the Lemont R -1 Single Family
Residence District parcel to Lemont R -4 Single Family Detached Residence District and rezone
to R -5 Single Family Attached Residence District Planned Unit Development (PUD) from Cook
County R -4 Zoning (Single Family Residence District), pursuant to Sections XVI and XVIII- I
and J.
WHEREAS, the Plan Commission met on December 10, 2002 and made a recommended
approval of the request . for a residential PUD development; and
WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in
accordance with said Zoning Ordinance, conducted a Public Hearing on the petition on June 17th
and July 15, 2003, and voted 3 -3 one absent on a motion to approve the zoning amendment and
PUD; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided
by law and was published in the Lemont Reporter Met, a newspaper of general circulation within
the Village; and
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of
the Village of Lemont, that the Petitioner, Paul Klabacha, Clayback Development, LLC, be
granted the requested R -4 Single Family Detached Residential District and R -5 Single Family
Attached Residence District Planned Unit Development from Cook County R -4 Zoning (Single
Family Residence District).
Section 1. That the Village of Lemont zoning map is hereby amended to classify subject
property R -4 Single Family Detached Residence District over lots 9 through 26 inclusive, and R-
5 Single Family Attached Residence District over lots 1 through 8, inclusive, on the attached
Preliminary Plan, Exhibit "B".
Section 2. That the Village Board of Trustees grants approval of the Preliminary PUD,
including the following variations to Section 23 of the Lemont Zoning Ordinance:
a. Reduction of minimum width of local street right of way from 66 feet to 60 feet.
b. Reduction of the minimal horizontal curve at an "L" intersection from 250 feet to 90 feet
c. Deferral of installation of public sidewalk on the east side of Limestone Drive until
such time as subdivision or development occurs on the east side of the street.
d. Increase of the maximum height of a fence from six feet to twelve feet to allow
construction of a cast concrete sight and sound barrier between the development and
the Ruffled Feathers maintenance building to the east.
Section 3. The Special Use Planned Unit Development approval shall lapse in the event
the Petitioner does not file a complete application for a site development permit within one (1)
year of the effective date of this AGREEMENT.
