AN ORDINANCE LOCALLY AMENDING THE 2000 INTERNATIONAL
RESIDENTIAL CODE, APPENDIX G, SECTION AG105.2, ITEM 8
WHEREAS, the Village has adopted the 2000 International Residential Code;
and
WHEREAS, the Village Board of Trustees recognizes the intent of Section AG
105 (Barrier Requirements) to Appendix G to the 2000 International Residential Code is
to ensure adequate safety for recreational swimming pools, spas and hot tubs, and
WHEREAS, the Village Board acknowledges the varied topography, odd - shaped
lots, and relatively large lot sizes found within the corporate boundaries and environs of
the Village, and that the distinction between a barrier fence and a fence surrounding the
lot is sometimes not precise; and
WHEREAS, the Village Board, taking into consideration such safety concerns
associated with barriers to swimming pools has determined that a buffer of 20 feet from
water's edge to an inward opening barrier gate is sufficient to provide adequate safety,
WHEREAS, the President and Board of Trustees of the Village have determined
that the best interests of the Village will be served by approving the amendment as
described herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF
COOK, DUPAGE, AND WILL, ILLINOIS that the 2000 International Residential
Code, Appendix G, Section AG105.2, Item 8, is hereby amended to read:
"Access gates shall comply with the requirements of section AG105.2,
Items 1 through 7, and shall be equipped to accommodate a locking
device. Pedestrian access gates erected or existing less than 20 feet from
the pool, as measured from the water's edge of the pool in a direct line to
the latching side of the gate, shall open outward away from the pool and
shall be self - closing and have a self - latching device. Pedestrian gates
erected or existing 20 feet or more from the pool, as measured from the
nearest water's edge in a direct line to the latching side of the gates, shall
be self - closing and have a self - latching device and may swing in either an
inward or outward direction. Gates other than pedestrian access gates
shall have a self - latching device. Where the release mechanism of the
self - latching device is located less than 54 inches (1372mm) from the
bottom of the gate, the release mechanism and openings shall comply with
the following:"
