SUBDIVISION, SPECIAL USE FOR A RESIDENTIAL PLANNED UNIT
DEVELOPMENT (PUD) AND REZONING FROM COOK COUNTY R-4 AND LEMONT
R-3 ZONING (SINGLE FAMILY DETACHED RESIDENCE DISTRICT) TO LEMONT
R-4 (SINGLE FAMILY ATTACHED RESIDENCE DISTRICT) FOR A 15 ACRE
PARCEL LOCATED AT 15002,15008 AND 15070 127th STREET IN LEMONT,
ILLINOIS

WHEREAS, Andrze J. Benarczyk with All Pro Development, Inc., hereinafter referred to
as "the Petitioner", are the owners of approximately 15 acres, hereinafter referred to as "the
subject property", PIN 22-33-100-005, 22-33-100-006, 22-33-100-008, 22-33-100-009 and 22-
33-100-010 in Lemont, Illinois; said parcel is legally described in Exhibit A and depicted on
Exhibit B; and
WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning
Ordinance to receive approval of preliminary plat of subdivision, rezone the subject property
from Cook County R-4 Zoning (Single Family Residence District) and Lemont R-3 (Single
Family Detached Residence District) to Lemont R-4 Zoning (Single Family Detached Residence
District) with a special use for a planned unit development, pursuant under Sections XVI and
XVIII.I and J; and
WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in
accordance with said Zoning Ordinance, conducted Public Hearings on the petition on October 4,
2005, November 1, 2005 and November 15, 2005 and recommended to the Village Board
approval for preliminary plat of subdivision, rezoning and PUD by a vote of 7-0; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided
by law and was published in the Lemont Reporter Met, a newspaper of general circulation within
the Village; and
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND
WILL, ILLINOIS:
Section 1. Approval of a zoning map amendment is granted to allow the change in
the zoning classification of the subject property located at PIN's 22-33-100-005, 22-33-100-006,
22-33-100-008, 22-33-100-009 and 22-33-100-010 from Lemont R-3 Zoning (Single Family
Detached Residence District) and Cook County R- to R-4 Zoning (Single Family detached
Residence), as illustrated in the Plat of Survey attached as Exhibit B.
Section 2. The Preliminary Plat of Subdivision for Krystyna Crossing, as prepared by
Geopool Land Surveyors, with a revision date of June 9, 2006, attached to this Ordinance as Exhibit
C, is hereby approved with the following conditions that must be completed prior to Final Plat of
Subdivision approval:
1. The Preliminary Landscape Plan, as prepared by Couture Landscape Construction
and dated September 10, 2005 with a revision date of March 15, 2006, shall be
revised to incorporate the comments noted in the letters from Urban Forest
Management, LTD dated July 8, 2006. Prior to Final Plat approval the
Community Development Director and/or the Urban Forest Management, LTD
must review and approve a Final Landscape Plan.
2. The Tree Preservation Plan, as prepared by Couture Landscape Construction and
dated September 10, 2005 with a revision date of March 15, 2006, shall be
revised to incorporate the comments noted in the letters from Urban Forest
Management, LTD dated July 8, 2006. Prior to Final Plat approval the
Community Development Director and/or the Urban Forest Management, LTD
must review and approve a Final Landscape Plan.
3. The tree inventory, with a revision date of September 7, 2004, shall be revised to
incorporate the comments noted in the letters dated October 2, 2004 and October
24, 2005. The tree inventory and the Tree Preservation Plan must correspond
with each other.
4. The Final Engineering Plans, prepared by Amerbuild Inc., dated December 1,
2005, with a revision date of August 22, 2006, shall be revised and approved by
Crawford Murphy & Tilly, Inc. prior to Final Plat of Subdivision approval.
5. All storm sewers need to be located within public utility easements and out of
buildable area of lots.
6. The southern terminus for Krystyna Crossing must be added to the Plat.
Section 3. Approval of a special use - planned unit development is granted as provided
in Lemont Zoning Ordinance, §XVI.H (Special Use - Planned Unit Developments) with the
following variations and conditions:
a. A variation from §VII.E.4.f of the Lemont Zoning Ordinance to decrease the
minimum lot width from 90 feet at the building line to 88 feet for 1otl2 and 86 feet
for lot 17.
b. A variation from §7.02.B.9 of the Standard Specifications for Design and
Construction of Public Improvements to increase the maximum high water depth for
dry detention ponds from four feet to six feet.
c. The front yard setbacks for lots 6 - 9 shall be as follows:
1. Lot 6 - 28 feet;
2. Lot 7 - 65 feet;
3. Lot 8 - 40 feet;
4. Lot 9 - 28 feet.
d. Planned Unit Development approval shall lapse in the event the DEVELOPER does
not file for Final Plat of Subdivision within one (1) year of the effective date of this
AGREEMENT.
