RESOLUTION ACCEPTING A WATER MAIN EASEMENT
P.I.N. 22 -14- 300 -039
WHEREAS, the Village of Lemont has received a Water Main Easement from IMTT-
Lemont, Inc. for the Cook Composite /Ashland Chemical Water Main Extension (Main
Street: Parker Road to Maley Road), and
WHEREAS, said Water Main Easement allows for construction of the water main for the
Composite /Ashland Chemical Water Main Extension.
NOW THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the
Village of Lemont that the Water Main Easement attached hereto is hereby approved.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DuPAGE, ILLINOIS, on this 12th
day of September, 2005.

WATER MAIN EASEMENT
THIS GRANT OF EASEMENT, made
this 3rd day of August, 2005, from
IMTT - LEMONT, INC. of 13589 Main
Street, Lemont, Illinois 60439
(hereinafter referred to as "Grantors ").
to the VILLAGE OF LEMONT, a
Municipal Corporation organized and
existing under the laws of the State of
Illinois (hereinafter referred to as the
"Village "), having its principal office at
418 Main Street, Lemont, Illinois
60439.
WITNESSETH:
WHEREAS, the Village has requested a Water Main Easement under certain property that is
owned by the Grantors: and
WHEREAS. the Grantors are willing to grant said non - exclusive perpetual easement, right,
privilege, and authority to the Village. upon the terms and conditions herein set forth;
NOW, THEREFORE, in consideration of the mutual benefit of the parties, the Grantors do hereby
bargain, sell. grant. transfer and convey to their successors and assigns, the perpetual non-
exclusive easement, right, permission and authority to construct. reconstruct, repair, replace,
operate, and maintain a water main over the following described property:

IN CONSIDERATION of the grant of the perpetual easement, right, privilege and authority herein
contained, this Water Main Easement is subject to the following conditions:
FIRST: The Preambles set forth above are hereby incorporated into and made a part of this
Water Main Easement.
SECOND: The rights and obligations of the Grantors and the Village respectively hereunder,
shall inure to the benefit of and be binding upon their respective successors and assigns. and all
terms, conditions, and covenants herein shall be construed as covenants, running with the land.
THIRD: In consideration for granting the Water Main Easement, the Village will not require the
Grantor to connect to the Village system, but in the event the Grantor elects to make such
connection, the Village will not charge a recapture fee or any other fee not typically charged by
other users in the Villages water system.
FOURTH: The Village hereby represents and warrants that it will restore any disturbed property
to its original condition.
IN WITNESS WHEREOF, the Grantors and the Village have executed this instrument , and have
hereunto set their hands and seals on the day and date first written above, hereby releasing and
waiving all rights under and by virtue of the Homestead Exemption Laws of the State of Illinois.

A ten foot public utility easement for water main purposes over, under and through the fallowing described
property: Beginning at the intersection of the North line of the Northern Illinois Gas Co. Easement, as
recorded per document Number 18785600 and a line 51.00 feet Easterly of and parallel with the following
described line hereinafter called Line "A" (Line "A" is a line between a point 915.35 feet East of the West line
and 309.08 feet North of the South line of the Southwest 1/4 of Section 14. Township 37 North,, Range 11
East of the Third Principal Meridian and a point 1264.36 feet North of the South line and 744.61 feet East
of the West line of said Southwest 1/4): said Point of Beginning also being on the Westerly line of said ten
foot easement: thence Northerly along said line 51.00 feet easterly of and parallel with Line "A` to the
Northerly fine of the former lands of the Chicago and Des Plaines Valley Railroad Co. and there terminating,
the Easterly line of said 10 feet easement is lengthened and/or shortened to terminate on the Northerly and
Southerly lines described.
