RESOLUTION ACCEPTING A WATER MAIN EASEMENT
P.I.N. 22 -20- 101 -013
WHEREAS, the Village of Lemont has received a Water Main Easement from Daniel C.
Williams for the New Avenue Water Main Extension, and
WHEREAS, said Water Main Easement allows for construction of the water main for the
New Avenue Water Main Extension.
NOW THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the
Village of Lemont that the Water Main Easement attached hereto is hereby approved.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DuPAGE, ILLINOIS, on this 12th

WATER MAIN EASEMENT
THIS GRANT OF EASEMENT, made
this 26`h day of July, 2005, from
DANIEL C. WILLIAMS, of 16440 New
Avenue, Lemont, Illinois 60439
(hereinafter referred to as "Grantor"),
to the VILLAGE OF LEMONT, a
Municipal Corporation organized and
existing under the laws of the State of
Illinois (hereinafter referred to as the
"Village "), having its principal office at
418 Main Street, Lemont, Illinois
60439.
WITNESSETH:
WHEREAS, the Village has requested a Water Main Easement under certain property that is
owned by the Grantor; and
WHEREAS, the Grantor is willing to grant said non - exclusive perpetual easement, right, privilege,
and authority to the Village, upon the terms and conditions herein set forth;
NOW, THEREFORE, in consideration of the mutual benefit of the parties, the Grantor does hereby
bargain, sell, grant, transfer and convey to his successors and assigns, the perpetual non-
exclusive easement, right, permission and authority to construct, reconstruct, repair, replace,
operate, and maintain a water main over the following described property:
The North 4 feet, (as measured perpendicular to the Northerly line of Lot 6), of the
East 20 feet, (as measured along the Northerly Lot line of Lot 6), of Lot 6 in
Owner's Subdivision, being a subdivision of part of Lot 25 in County Clerk's
Division, being a subdivision of the East 1/2 of the Northwest 1/4 of Section 30,
Township 37 North, Range 11 East of the Third Principal Meridian, according to the
Plat of said Owner's Subdivision recorded June 21, 1927 as Document No.
9692985.

IN CONSIDERATION of the grant of the perpetual easement, right, privilege and authority herein
contained, this Water Main Easement is subject to the following conditions:
FIRST: The Preambles set forth above are hereby incorporated into and made a part of this
Water Main Easement.
SECOND: The rights and obligations of the Grantor and the Village respectively hereunder, shall
inure to the benefit of and be binding upon their respective successors and assigns, and all terms,
conditions, and covenants herein shall be construed as covenants, running with the land.
THIRD: In consideration for granting the Water Main Easement, the Village shall waive a future
water tap -on fee to the Grantor and /or his successors and assigns for one residential dwelling.
FOURTH: The Village hereby represents and warrants that it will restore any disturbed property
to its original condition.

FIFTH: The Village is aware of Grantor's concern of disruption during excavation and
construction of the water main and should the Village hinder flow of water from entering the
culvert, the Village will provide compensation for any resultant loss of property (personal or
otherwise) due to flood damage.
SIXTH: In the event the Grantor connects to the public water system they will be allowed to
maintain their existing well for irrigation purposes only as long as all work is done in compliance
with the Illinois Plumbing Code.
IN WITNESS WHEREOF, the Grantor and the Village have executed this instrument , and have
hereunto set their hands and seals on the day and date first written above, hereby releasing and
waiving all rights under and by virtue of the Homestead Exemption Laws of the State of Illinois.
