NOW THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont that the Water Main Easement attached hereto is hereby approved. Permanent Tax Index No: 22 -20 -101 -043 Common known address: 16430 New Avenue, Lemont, Illinois 60439 IN CONSIDERATION of the grant of the perpetual easement, right, privilege and authority herein contained, this Water Main Easement is subject to the following conditions: FIRST: The Preambles set forth above are hereby incorporated into and made a part of this Water Main Easement. SECOND: The rights and obligations of the Grantors and the Village respectively hereunder, shall inure to the benefit of and be binding upon their respective successors and assigns, and all terms, conditions, and covenants herein shall be construed as covenants, running with the land. THIRD: In consideration for granting the Water Main Easement, the Village hereby waives any and all fees, charges or costs, including but not limited to water tap on fees, for two water hook -ups for two residential dwellings on the property of Grantors, and /or their successors and assigns. In addition, at the time the water main is placed, the Village shall install two separate connections in the water main and at least a 1 1/4 inch line to two buffalo boxes to serve Grantors' property. FOURTH: The Village represents and warrants that, in connection with the installation of the water main and any subsequent reconstruction, repair or replacement of the water main, it will restore Grantors' property to the condition it was in when the work began, within 45 days after the work commences. If the property is not so restored within such 45 day period, Grantors and /or their successors and assigns may, at their option, restore the property to its condition prior to commencement of the work, and the Village will reimburse the Grantors and/or their successors and assigns within 30 days after a bill is submitted to the Village. If payment is not received within such 30 day period the Village shall pay the reasonable attorneys' fees and costs incurred by Grantors and /or their successors and assigns to collect any amounts due under this easement. FIFTH: The Village agrees to indemnify, defend and hold the Grantors and/or their successors and assigns harmless from and against any liability, Toss, damages or expense arising out of the installation and operation of a water main on Grantors' property. SIXTH: The Village will reimburse Grantors for attorney review fee of $250.00.
