SECOND: The rights and obligations of the Grantor and the Village respectively hereunder, shall inure to the benefit of and be binding upon their respective successors and assigns, and all terms, conditions, and covenants herein shall be construed as covenants, running with the land. THIRD: In consideration for granting the Sewer and Water Main Easement, the Village hereby waives any and all changes, including but not limited to water tap on fees for one water hook -up for one residential dwelling on the property of Grantor, and reimburse the Grantor for the cost of connecting water service to existing residence. FOURTH: The Village hereby represents and warrants that it will restore any disturbed property to its original condition.
