AN ORDINANCE GRANTING THE REQUEST FOR A SPECIAL USE FOR A
PLANNED UNIT DEVELOPMENT (PUD) ON A 7.2 ACRE PARCEL(S), LOCATED
AT 1237, 1243 AND 1251 S. STATE STREET AND REZONING FROM B -3 ARTERIAL
COMMERCIAL DISTRICT AND COOK COUNTY R -4 RESIDENCE DISTRICT TO VILLAGE
B -3 PUD (PLANNED UNIT DEVELOPMENT) IN LEMONT, ILLINOIS
(LEMONT VILLAGE SQUARE PUD)
WHEREAS, Matt Okmin of OS Lemont Development L.L.C., hereinafter referred to as "the
Petitioner ", are the owners of approximately 3 acres, hereinafter referred to as "the subject property ", PIN#
22 -33- 200 -044 and PIN # 22 -33- 200 -008, in Lemont, Illinois; said parcels are legally described in
"Exhibit A" attached to this Ordinance; and
WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning
Ordinance for a commercial planned unit development to rezone the parcel to B -3 Planned Unit
Development from Village B -3 Arterial Commercial District and Cook County R -4 Residential Zoning
District, pursuant under Sections XVI and XVIII I and J.
WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with
said Zoning Ordinance, conducted Public Hearings on the petition on December 16, 2004 and January 4,
2005 and has approved said PUD by a vote of 6 -0 with one absence, and recommends approval to the
Village Board; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law
and was published in the Lemont Reporter Met, a newspaper of general circulation within the Village; and
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village
of Lemont, that the Petitioner, Matt Okmin for OS Lemont Development, be granted the requested
commercial planned unit development zoning (B -3 PUD) from Cook County R -4 Zoning District and
Lemont B -3 Commercial Arterial District.
Section 1. A zoning map amendment is granted to allow the change in the zoning classification of
B -3 Commercial Arterial District and Cook County R-4 Residence District to Lemont B -3 PUD, as
illustrated in the Plat of Survey attached as Exhibit `B ".
Section 2. The following conditions are made a part of this Ordinance:
1. Development shall substantially conform to all exhibits attached as Exhibit "C ".
2. Delivery and loading shall be limited to two vehicles between the hours of midnight and 6:00
a.m. daily.
3. Prior to commencement of development, a final plat of consolidation shall be approved and
recorded.
4. No outdoor sales or storage shall be permitted, with the exception of the outdoor cafe use
(sales of food and beverage) at the "out - parcel" (coffee shop /ice cream parlor) building and
outdoor merchandise display within the fenced enclosure south of the Ace Hardware building.
5. The curbed access aisle in front of the in -line tenants shall be marked "No Parking: Fire Lane ".
6. Mechanical units (roof top or ground mounted) shall be screened from public view. (Design
note: mechanical units should be screened from public view by perapet or rooftop screen type
structure)
7. Bicycle parking spaces shall be installed as indicated on the site plan.
Section 3. The Planned Unit Development approval shall lapse in the event the Petitioner does not
file a complete application for a site development permit within one (1) year of the effective date of this
AGREEMENT.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DU PAGE, ILLINOIS, on this 14th
day of February, 2005.
