CUSTER STREET IN LEMONT, ILLINOIS WHEREAS, Paul Laketa, hereinafter referred to as "the Petitioner," is the owner of a 14,788 square foot parcel, hereinafter referred to as "the subject property," located at 37 East Custer Street in Lemont, Illinois and legally described in Exhibit "A "; and WHEREAS, the applicant is seeking variations to the Lemont Zoning Ordinance, Section VII.E.10[c][1] to increase the maximum total impervious allowance of the lot area for accessory structures and driveways from 15% to 22.1 %, and Section VII.E.10[e][2], to increase the impervious allowance of the total lot area of a driveway. WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois (the "Village ") did heretofore continence and conduct Public Hearings on January 4, 2005 and January 18, 2005 for approval of Variations; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter/Met a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the variation as described herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND WILL, ILLINOIS: SECTION 1: Impervious Surfaces: A variation is granted to increase the maximum total impervious allowance from fifteen percent (15 %) to 22.1 percent of the lot area for accessory structures and driveways, pursuant to Section VII.E.10.[c].[1] of the Lemont Zoning Ordinance; and SECTION 2: Driveways: A variation shall be approved to increase the maximum five percent (5 %) of the total lot area to 12.1 percent of the total lot area, pursuant to Section VII.E.10[e][2]. SECTION 3: Side Setback: A variation shall be approved to reduce the minimum side yard for a detached accessory structure from five (5) feet to two (2) feet, two (2) inches on the west side lot line of the subject property. SECTION 3: Conditions of Approval: The above variations shall be approved subject to the following conditions: 1. Construction of the accessory structure shall be in substantial conformance with the petitioner's revised sketch illustrating a minimum seven (7) foot setback from the north property line. 2. The combination of all accessory structures shall be no greater than ten percent (10 %) of the lot area; 3. Projecting eaves shall be limited to not more than eighteen (18) inches of overhang; 4. The mean roof height of a shed roof shall be no greater than fifteen (15) feet and the height at the north end of the building shall be no greater than twelve (12) feet, nine (9) inches in height; and 5. Construction materials for the new structure are to be as represented by the petitioner. Section 4. Approval of the variations shall lapse in the event the Petitioner does not file a complete application for a permit within one (1) year of the effective date of this Ordinance.
