AN ORDINANCE APPROVING ZONING VARIATIONS FOR REDUCTION OF A
PARKING LOT SETBACK FROM A PUBLIC RIGHT -OF -WAY, REDUCTION OF
REQUIRED PERIMETER LANDSCAPING, REDUCTION OF MINIMUM ON -SITE
PARKING SPACES, AN INCREASE OF MAXIMUM HEIGHT AND GROSS
SURFACE AREA OF A GROUND SIGN, AND REDUCTION OF THE MINIMUM
WIDTH OF A COMMERCIAL SIDEWALK AT MCDONALDS RESTAURANT

WHEREAS, McDonalds Corporation, hereinafter referred to as "the Petitioner," is the
owner of a 1.03 acre parcel, hereinafter referred to as "the subject property," located at 1152
State Street in Lemont, Illinois and legally described in Exhibit "A "; and
WHEREAS, the Petitioner is seeking relief to the Lemont Zoning Ordinance to reduce
the parking lot setback from a public right -of -way, reduce the required perimeter landscaping,
reduce the minimum on -site parking spaces, increase the maximum height and gross surface area
of a ground sign, and reduce the minimum width of a commercial sidewalk in the B -3 Arterial
Commercial Business District, pursuant to Lemont Zoning Ordinance Sections XII.D.7 (Parking
Location), XII.D.11.d. (Parking Requirements), XIII.H.2.a. (Lot Perimeter Landscaping) and
XV.E.3.a and b (Commercial Sign Standards), and XVIII.I (Variations), and the Standard
Specifications Ordinance Section 3.02C (Public Sidewalks); and
WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois (the
"Village ") did heretofore commence and conduct a Public Hearing on March 15, 2005 for zoning
variations in the B -3 Arterial Commercial Business District; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided
by law and was published in the Lemont Reporter/Met a newspaper of general circulation within
the Village; and
WHEREAS, the President and Board of Trustees of the Village of Lemont, after a public
hearing as required by law, recommended approval of the variations in the B -3 Arterial
Commercial Business District; and
WHEREAS, approval of the relief requested will enable the petitioner to obtain a
reasonable return from the property for a project that will replace an existing non - conforming
building, parking lot, and signs with a building, parking lot, and signs that more nearly conform
to the current regulations and standards of Lemont Zoning Ordinance; and
WHEREAS, the President and Board of Trustees of the Village have determined that the
best interests of the Village will be served by approving the variations as described herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE,
AND WILL, ILLINOIS:
Section 1: A variation is granted to reduce the parking lot setback from a public right of
way from fifteen (15) feet to four (4) feet on the north side of the subject property pursuant to
Ordinance Section XII.D.7.
Section 2: A variation is granted to reduce the required perimeter landscape adjacent to
commercial property from ten (10) feet to three (3) feet on the south and west sides, pursuant to
Ordinance Section XIII.H.2.a.
Section 3: A variation is granted to reduce the minimum number of on -site parking
spaces from 55 to 49 spaces pursuant to Ordinance Section XILD.1I.d..
Section 4: A variation is granted to increase the maximum height of a ground sign from
eight (8) feet to sixteen feet, ten inches (13' 10 ") feet exclusive of the monument detail pursuant
to Ordinance Section XV.F.3.a;
Section 5: A variation is granted to increase the maximum gross surface area of a ground
sign from sixty (60) square feet to eighty (72) square feet exclusive of the sign monument,
pursuant to Ordinance Section XV.F.3.b.;
Section 6: A variation is granted to reduce the minimum width of a commercial sidewalk
from six feet to five feet pursuant to Ordinance Section 3.02C of the Standard Specifications for
Section 7: Findings: The following exhibits shall be made part of the findings of fact:
A. Building elevations, McDonald's Corporation, date issued October 2002.
B. Final Engineering Plans, Compass Consulting Group, sheets C -1 through C -7
inclusive, sheets P -1, SD -1 through 3 inclusive, and T -1, dated March 9, 2005
(latest revision).
C. Landscape Plan, Dahl Landscape Company, sheet L -1, last revised March 9,
2005.
D. Sign Elevations, Everbrite Identity Systems, received April 6, 2005.
