'65' AN ORDINANCE EXCLUDING CERTAIN PROPERTY TO BE ANNEXED TO THE VILLAGE OF WOODRIDGE ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT This 22nd day of August , 2005 Published in pamphlet form by authority of the President and Board of Trustees of the Village of Lemont, Counties of Cook, Will, and DuPage, Illinois this 22nd day of Aueust ,2005 VILLAGE OF LE O_NTT, ORDINANCE NO. f 'O� AN ORDINANCE EXCLUDING CERTAIN PROPERTY TO BE ANNEXED TO THE VILLAGE OF WOODRIDGE WHEREAS, certain real property, legally described on Exhibit "A" attached (the "Subject Property") is currently within the corporate limits of the Village of Lemont ( "Lemont "); and WHEREAS, on or about July, 2005, Lemont entered into that certain Intergovernmental Jurisdictional Boundary Line Agreement with the Village of Woodridge, DuPage and Will Counties, Illinois ( "Woodridge "), which Agreement provides for, among other things, the exclusion of the Subject Property from Lemont and annexation to Woodridge. WHEREAS, the Subject Property is unoccupied and lies along the boundary line between Woodridge and Lemont; and WHEREAS, Lemont desires to exclude the Subject Property and Woodridge desires to annex the Subject Property; and WHEREAS, Lemont is authorized to exclude the Subject Property pursuant to 65 ILCS 5/7 -1 -25 and other applicable authority; and WHEREAS, the President and Board of Trustees have determined that the exclusion of the Subject Property is necessary to promote the public health, safety and general welfare. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DUPAGE, ILLINOIS AS FOLLOWS: Section 1. That the Subject Property is hereby excluded from the Village of Lemont and the President and Village Clerk are hereby authorized and directed to execute the Plat of Exclusion in substantially the form attached hereto as Exhibit `B" and incorporated herein. Section 3. That all Ordinances or Resolutions, or parts thereof in conflict with the provisions of this Ordinance are, to the extent of such conflict, expressly repealed. Section 4. This Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law; provided however, that the exclusion of the Subject Property shall not be effective until such time as Woodridge passes and approves an ordinance which annexes the entire Subject Property, as described and set forth in the attached Plat of Exclusions. Further, this Ordinance will not become effective until a $320,000 reimbursement is received from Bridge Development for property previously disconnected.
