RESOLUTION APPROVING PRELIMINARY PLAT OF SUBDIVISION
( "The Highlands ")
WHEREAS, the petitioner is the owner of the subject property consisting of 67.14 acres,
located on the north side of 13151 Street, approximately 1,300 feet west of Bell Road in
unincorporated Cook County and legally described in Exhibit "A" attached; and
WHEREAS, the subject property is within contiguous areas lying within one and one
half miles beyond the corporate limits of the Village of Lemont; and
WHEREAS, the petitioner has submitted the Preliminary Plat of Subdivision for the
subject property, which is known as "The Highlands" Subdivision, attached hereto as Exhibit
"B ", consisting of:
1. Resolution Approving a Preliminary Plat.
2. Site Plan, prepared by Ives /Ryan Group, last revised February 4, 2004.
3. Preliminary Engineering, prepared by C.M. Lavoie & Associates, dated February 2, 2004.
4. Preliminary Plat, prepared by C.M. Lavoie & Associates, dated February 2, 2004.
5. Landscape Plan (sheet L -1) and Entrance Details (sheet L -2), prepared by Ives/Ryan
Group, last revised February 4, 2004.
6. Sewer Extension Project /Master Utility Plan, prepared by C.M. Lavoie & Associates last
revised December 22, 2003.
7. Tree Location Map, prepared by C.M Lavoie & Associates, dated February 2, 2004.
8. Traffic Study dated March 2, 2004.
9. Cook County Ordinance dated June 18, 2002 approving CCZBA dockets 7131 and 7132
and Report of the Committee on Zoning and Building dated June 18, 2002; and
WHEREAS, the Preliminary Final Plat of Subdivision is in substantial conformance with
the physical development policies and standards of the Village of Lemont.
NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont that the Preliminary Plat for "The Highlands" Subdivision, which is
attached hereto and made a part hereof, is hereby approved, subject to compliance with the
following:

1. The developer shall pay school and park donations in the following amounts: Elementary
School: $204,541.94; High School: $92,326.96; and Park donation, a 2.29 acre park
site and $268,000 cash.
2. The bicycle path (10 foot width) shall be extended north to a point just east of the north boundary
of the subject property. The Plan Commission encourages the Park District to use the cash
contribution in part to extend the bike path system to 123rd Street (McCarthy Road).
3. As acknowledged by the project engineer's letter, a "no access" restriction shall be noted
on the 131st Street frontage of the final plat.
4. The lift station pump house should be designed to Village standard specifications, or if
designed to private utility company specifications, the developer shall be responsible for
landscape screening of the structure, as acknowledged by letter.
5. Provide home owners association documents including, but not limited to, plans for
ownership and maintenance of storm water detention areas and landscape outlots on the
two short cul -de -sacs.
6. A minimum of 50 percent of the exterior of dwellings shall be brick by restrictive covenant;
7. A maximum of 50 percent of the dwellings shall have a "front loaded" (garage opening on
front elevation) garage design and the remainder shall be "side- loaded" (garage opening on
a side elevation)
8. Public utility and drainage easements shall be wider as necessary on lots where
underground piping or emergency overflow rotes are planned.
9. Prior to final plat approval, the developer shall perform a drainage study to verify that the
storm water runoff will not have an adverse impact on downstream property.
10. Prior to final plat approval, the developer shall provide documentation of commitments to
provide water and sewer service, including private utility company service agreements,
Facility Planning Area (FPA) amendments/Illinois Water Quality Management Plan
amendments, certification of available capacity, and certificate of convenience and
necessity, as applicable.
11. Prior to final plat approval, documentation of lease, easement or license agreements
between the petitioner and Com Ed for bike path, storm detention, street crossing and
utility crossing purposes should be submitted.
12. The developer shall provide for Village review site /route plans of all off -site
improvements required or planned to handle sewage flows, including new lift stations and
force mains, existing lift station improvements, and treatment plant capacity
improvements as applicable.
13. A tree preservation plan that illustrates trees to be preserved, removed, or transplanted
shall be required.
14. The landscape plan shall specify that the off - street parking near model home lots 2 & 3 is
temporary and provide a detail of its replacement by landscaping.
15. Final plans shall be revised in response to review comments by the Acting Village
Engineer (see letter dated 10/7/03; memo of 2/24/04; and 4/5/04), including any additional
comments on the February 2004 submittals.
16. The Developer shall obtain an agreement with the Lemont Park District to accept the park
and bike path donations.
17. Minimum interior side yards of ten feet are acceptable in consideration of the bicycle path
system provided as an open space amenity in the subdivision.
