A RESOLUTION APPROVING VARIATIONS AND WAIVERS OF THE
LEMONT SUBDIVISION REGULATIONS, ORDINANCE #456
( Lot 12 in Lemont Gardens, or 903 East Street)
WHEREAS, Margaret and Andrew Fudala are the owners (hereinafter known as
petitioner) is the owner of the subject property consisting of approximately .25 acres,
lot 12 in Lemont Gardens, (commonly known as 903 East Street), and legally described
as:
Lot 12 in Lemont Gardens, a subdivision of lots 13 and 14 in County
Clerk's Division of Section 29, Township 37 North, Range 11, East of
the Third Principal Meridian, in Cook County, Illinois; and
WHEREAS, the petitioner has requested variations of the Subdivision
Regulations to construct a single family dwelling on the subject property; and
WHEREAS, the Lemont Plan Commission reviewed the proposed variations of
the Subdivision Regulations as provided in Section XVI of Ordinance 456 and
recommends approval; and
WHEREAS, the petitioner prepared an engineering drawing illustrating a street
extension, temporary "tee" turnaround and storm sewer public improvements within
existing unimproved right -of -way, attached hereto and made a part hereof as "Exhibit
B"; and
WHEREAS, the President and Board of Trustees have determined that the
approval of the specified engineering plan, and variations of the Subdivision
Regulations, Ordinance #456, shall be in the best interest of the Village; and
NOW, THEREFORE, BE IT RESOLVED by the President and Board of
Trustees that the requested relief shall consist of the following:
Section 1. Street construction shall not be required within the Short Street right
of way east of East Street, including waiver of public sidewalk and parkway trees along
Short Street.
Section 2. No additional street lights attributable to construction of the dwelling
on Lot 12 shall be required.
Section 3. The extension of East Street shall be required along the entire
frontage of Lot 12 and shall terminate in a "Tee" turnaround at approximately the center
line of Short Street.
Section 4. Site improvements shall be constructed in general conformance with
the "Site Grading Plan" prepared by Edward W. Podczerwinski, P.E., last revised May
8, 2004.
Section 5. The applicant shall provide a financial guarantee for the street
construction as provided in the Subdivision Regulations.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL,
AND DuPAGE, ILLINOIS, on this 24th day of May, 2004.
