RESOLUTION APPROVING FINAL PLAT
OF SUBDIVISION FOR LIMESTONE OF LEMONT SUBDIVISION
WHEREAS, Paul Klabacha, doing business as Clayback Development, LLC, hereinafter
referred to as "the Petitioner ", is the owner of an approximately 17.5 acre parcel, hereinafter
referred to as "the subject property ", located at 13640 to 13670 McCarthy Road in Lemont,
Illinois and legally described on Exhibit "A "; and
WHEREAS, the petitioner has prepared a Final Plat of Subdivision for the subject
property, which is known as Limestone of Lemont; and
WHEREAS the petitioner has submitted the Final Plat of Subdivision for a development of
16 multi - family dwelling units and 17 single - family dwelling units to be known as Limestone of
Lemont, and;
WHEREAS, the Final Plat of Subdivision is in substantial conformance with the
preliminary Planned Unit Development approved by Village Ordinance No. 0- 70 -03, approved on
October 27, 2003 and the physical development policies and standards of the Village of Lemont.
NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of the
Village of Lemont that the Final Plat of Subdivision for Limestone of Lemont, which is attached
hereto as Exhibit `B ", is hereby approved subject to the conditions below including terms and
provisions of the preliminary planned unit development authorized by Ordinance No. 0 -70 -03 and
annexation agreement authorized by Ordinance No. 0- 68 -03:
1. Land -cash contributions and the annexation fees have been paid to the Village of
Lemont in accordance with Village Ordinances, as follows:

Village Annexation Fee $ 3,675.00
TOTAL: $142,007.40
2. Include Subdivision Sign Easement Provisions to the Final Plat to read as:
i. A permanent non - exclusive easement in hereby reserved for and granted to
Homeowners Association and to its successors and
assigns, in upon, across, over and through the areas shown by dashed lines
and labeled "sign easement" on this plat, in such label, for the purpose of
the placement of identification signs. No permanent buildings or

structures, except such signs hereby permitted, shall be placed on said
easement. No term or condition convened in this easement relating to signs
shall limit or preclude the exercise of any rights granted pursuant to any
other easement reserved and/or granted on this plat for any other purpose.
Signs shall be installed in conformance with applicable codes and
ordinances of the Village of Lemont.
3. A letter of credit guarantee equal to 115 percent of the engineer's estimate shall be
collected prior to the issuance of a full site development permit along with the
appropriate site development fees.
