AN ORDINANCE PROPOSING THE ESTABLISHMENT OF
SPECIAL SERVICE AREA NO. 1 BY THE VILLAGE OF
LEMONT FOR CONSTRUCTING SANITARY SEWER AND WATER
MAIN EXTENSIONS AND PROVIDING FOR A PUBUC
HEARING AND OTHER PROCEDURES IN CONNECTION
THEREWITH
BE IT ORDAINED by the Village President and Board of Trustees of the Village of Lemont,
Cook County. Illinois, as follows:
Section 1: Authority to Establish Special Service Areas. That the Village of Lemont
(the "Village ") has authority pursuant to Article VII, Section 7 of the Illinois Constitution of 1970 to
provide special services to contiguous areas within its corporate limits and within the corporate
limits of other consenting municipalities; and to provide the manner of levying and imposing
additional taxes to pay the cost of such special service in accordance with the provisions of the
Special Service Area Tax Law, 35 ILCS 200/27 -5, et seq.
Section 2: Findings. This Village President and Board of Trustees finds as follows:
(a) that it is in the public interest that the creation of a special service area
(the "SSA ") for the purposes set forth herein be considered;
(b) that the SSA is compact and contiguous and is located within the Village;
(c) that the SSA will specially benefit from the construction of a sanitary
sewer system and water system, which construction is in addition to
municipal services generally provided by the Village as a whole and it is;
therefore, in the best interest of the SSA that the levy of special taxes
and the issuance of bonds in the SSA be considered.
(d) that the SSA will be known as Village of Lemont Special Service Area
No. 1.
Section 3: Public Hearing - Tax Rates - Bonds. That a public hearing shall be held at
4:00 p.m. on Thursday, June 5, 2008, in the Boardroom of the Village Hall, 418 Main Street,
Lemont, Illinois, to consider the creation of the SSA, in the following described territory within the
Village:
BEGINNING AT THE INTERSECTION OF THE NORTH LINE OF THE SOUTHEAST 1/4 OF SECTION 14,
TOWNSHIP 37 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN AND THE WEST LINE
OF LOT 1 IN CHARLES E. BOYER'S SUBDIVISION, BEING A SUBDIVISION IN THE WEST 1/2 OF THE
SOUTHEAST 1/4 OF SECTION 14, TOWNSHIP 37 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL
MERIDIAN; THENCE EAST ALONG THE NORTH LINE OF THE SOUTHEAST 1/4 OF SAID SECTION 14
TO THE NORTHEAST CORNER OF MENO'S SUBDIVISION, BEING A SUBDIVISION OF PART OF THE

At the hearing, there will be considered the levy of an annual tax of unlimited rate on the
property in the SSA, said tax to be levied for a maximum of twenty (20) years which tax shall be in
addition to all other taxes provided by law.
At the hearing, there will be considered the issuance of bonds in an amount not to exceed
$1,350,000 to be paid over not more than twenty (20) years and bearing interest at a rate not to
exceed 6.5% per annum.
Section 4: Notice of Hearing. Notice of hearing, in substantially the form attached
hereto, shall be published at least once not less than fifteen (15) days prior to the public hearing in
one or more newspapers in general circulation in the Village. In addition, notice by mailing shall be
given by depositing said notice in the U. S. mails addressed to the person or persons in whose
name the general taxes for the last preceding year were paid on each lot, block, tract or parcel of
land lying within the proposed SSA. Said Notice shall be mailed not less than ten (10) days prior to
the time set for the public hearing. In the event taxes for the last preceding year were not paid, the
Notice shall be sent to the person last listed on the tax rolls prior to that year as the owner of the
property
Section 5: Effective Date. This Ordinance shall be in full force and effect from and after
its passage and approval as provided by law.

commonly described as an area located west of Illinois Route 83 and Archer Bell Avenue, north of
Archer Avenue and south of the Canadian National Railroad right -of -way (see attached map). The
special services to be provided will be the construction of a sanitary sewer system and a water main
system.
All interested persons affected will be given an opportunity to be heard and object to the
formation of the special service area, the levy of taxes affecting said area, and the issuance of
bonds.
A special tax will be considered at the public hearing to be levied for a period not to exceed
20 years at an unlimited rate, to be levied against the property included in the special service area.
The issuance of bonds in an amount not to exceed $1,350,000 payable over not more than 20
years at an interest rate not to exceed 6.5% will also be considered at the public hearing.
At the hearing, all persons affected will be given an opportunity to be heard. The hearing
may be adjourned by the Village President and Board of Trustees without further notice to another
date without further notice other than a motion to be entered upon the minutes of its meeting fixing
the time and place of its adjournment.
If a petition signed by at least 51 % of the electors residing within the proposed special
service area and by at least 51 % of the owners of record of the land included within the boundaries
of the proposed special service area is filed with the Village Clerk within 60 days following the final
adjournment of the public hearing objecting to the creation of the special service district, the
enlargement thereof, the levy or imposition of a tax or the issuance of bonds for the provision of
special services to the area, no such district may be created or enlarged, or tax may be levied or
imposed, or no such bonds may be issued.
