AN ORDINANCE AMENDING ORDIANCE 0 -72 -07 TO EXTEND THE EXPIRATION
DATE OF A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT (PUD) ON A 4.8-
ACRE PARCEL LOCATED AT THE NORTHWEST CORNER OF 127TH STREET AND
THORNBERRY DRIVE IN LEMONT, ILLINOIS

WHEREAS, McNaughten Development, Inc., hereinafter referred to as "the Petitioner,"
is the owner of an approximately 4.8 acre parcel, hereinafter referred to as "the subject property,"
located at the northwest corner of 127th Street and Thornberry Drive in Lemont, Illinois and
described in the attached legal description as Exhibit A; and
WHEREAS, the Petitioner made application under provisions of the Lemont Zoning
Ordinance, Section XVI.G.1 for a Special Use for a Planned Unit Development to develop an
office complex the B -3 District; and
WHEREAS, the Village Board of Trustees approved Ordinance 0- 72 -07, granting
approval said requests, on September 10, 2007; and
WHEREAS, the Petitioner prefers to delay the start of the project due to market
considerations, and has therefore requested this amendment.
NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:
Section 1. That Section 3 of Ordinance 0 -72 -07 is amended as follows:
1. A complete building permit application has not been received by the Village for such
construction, installation, or relocation within three years after the effective date of
the ordinance granting said special use; or
2. A building permit has been issued within one year of the effective date of the special
use, but such construction, installation or relocation has not commenced within one
year after the issuance of the building permit.
3. In the event a special use lapses, nothing herein shall prohibit any person from
applying for the same special use or a new special use on substantially the same
terms.
Section 2. That all other Sections and Conditions of Ordinance 0 -72 -07 remain as they
were upon approval by the Village Board of Trustees on September 10, 2007.

WHEREAS, McNaughten Development, Inc., hereinafter referred to as "the Petitioner ",
is the owner of an approximately 4.8 acre parcel, hereinafter referred to as "the subject property ",
located at the northwest corner of 12701 Street and Thornberry Drive in Lemont, Illinois and
described in the attached legal description as Exhibit A; and
WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning
Ordinance, Section XVLG,1 for a Special Use for a Planned Unit Development to develop an
office complex the B -3 District; and
WHEREAS, the PIanning and Zoning Commission of the Village of Lemont, Illinois, in
accordance with said Zoning Ordinance, conducted a Public Hearing on the petition on June 19,
2007; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided
by law and was published in the Daily Southtown, a newspaper of general circulation within the
Village; and
WHEREAS, the President and Board of Trustees of the Village have determined that the
best interests of the Village will be served by approving the Special Use for a Planned Unit
Development.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE 01? LEMONT, COUNTIES OF COOK, DuPAGE,
AND WILL, ILLINOIS:
Section 1. Approval of a Special Use for a Planned Unit Development. A Special Use
for a Planned Unit Development is approved to allow the construction an office complex with at
the northwest corner of 1271" Street and Thornberry Drive in Lemont, Illinois as described in the
attached legal description, Exhibit A, subject to the conditions listed in Section 2 of this
ordinance.
Section 2. Conditions of Approval of a Special Use for a Planned Unit Development.
The following conditions apply:
1. The site construction, utility installation and grading shall not commence until a Site
Development Permit is issued by the Village.
2. The buildings shall be constructed consistent with the conceptual elevation prepared by
arete 3 ltd and dated February 8, 2007 (Exhibit B), and the attached building material
list dated May 15, 2007 (Exhibit C).
3. The Landscape Plan, as prepared by Ives /Ryan Group, with a revision date of June 26,
2007, (Exhibit D) shall be revised to incorporate the comments noted in the May 6, 2007
review from Urban Forest Management, Inc. and will be subject to further review.
4. Engineering Plans, prepared by DesignTek Engineering, Inc., with a revision date of
July17, 2007 (Exhibit E) shall be revised to incorporate the comments from the May 9,
2007, review by Jim Cainkar, Village Engineer and be subject to further review.
5. No deliveries will be allowed to the buildings between the hours of 9:00 p.m, and 7:00
a.ln.
Section 3. A special use for a PUD shall lapse in the event of the following:
1. A complete building permit application has not been received by the Village for such
construction, installation, or relocation within one year after the effective date of the
ordinance granting said special use; or
2. A building permit has been issued within one year of the effective date of the special use,
but such construction, installation or relocation has not commenced within one year after the
issuance of the building permit.
3. In the event a special use lapses, nothing herein shall prohibit any person from applying
for the same special use or a new special use on substantially the same terms."
Section 4. That this ordinance shall be in force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.

OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DU PAGE,
ILLINOIS, on this 10th day of September, 2007.
