AN ORDINANCE AMENDING THE ZONING MAP OF THE VILLAGE OF LEMONT FROM R -4 SINGLE - FAMILY DETACHED RESIDENTIAL DISTRICT AND B -3 ARTERIAL COMMERCIAL DISTRICT TO INT INSTITUTIONAL DISTRICT (Lemont Police Station) WHEREAS, the Village of Lemont, hereinafter referred to as the "Applicant ", is the owner of certain land generally located at 12900 and 14574 127th Street in Lemont, Illinois, with PINs 22 -33- 200 -01 1 -0000 and 22 -33- 200 - 014 -0000, and legally described in Exhibit "A ", and depicted in Exhibit `B "; and, WHEREAS, the Applicant applied under the provisions of the Village of Lemont Unified Development Ordinance, Ordinance # 0 -7 -08, as amended, hereinafter referred to as the "Unified Development Ordinance" to rezone the subject property to INT (Institutional) Zoning from R -4 (Single Family Detached Residential) and B -3 (Arterial Commercial) Zoning; and, WHEREAS, the Planning and Zoning Commission conducted a Public Hearing on the application in accordance with said Unified Development Ordinance on August 12, 2008; and, WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Southtown Star, a newspaper of general circulation within the Village; and WHEREAS the Planning and Zoning Commission adopted the following Findings of Fact at the Public Hearing that: 1. The rezoning is appropriate given the two institutional uses adjacent to the subject property (i.e. the future church site and the township maintenance facility); 2. The relative gain to the public from the rezoning outweighs any potential decline in nearby property values; 3. The subject property is suitable for the proposed rezoning because it will help the applicant uphold the public safety of the community; and, 4. The community has a need for the rezoning to offset future space limitations at the current police station and to fulfill an objective in the Comprehensive Plan; and, WHEREAS, the Planning and Zoning Commission voted 6 -0 with 1 absent to recommend said rezoning; and, WHEREAS, the President and Board of Trustees of the Village of Lemont hereby concur with and adopt said Findings of Fact; and, WHEREAS, the President and Board of Trustees of the Village of Lemont have determined that the best interest of the Village will be served by approving the Zoning Map 2 Amendment described herein. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont, Counties of Cook, Dupage, and Will, State of Illinois, as follows: Section 1 Zoning Map Amendment. That the subject property described above is hereby rezoned from its current R -4 Single Family Residence District and B -3 Arterial Commercial District to the INT Institutional District. The zoning map of the Village of Lemont is hereby amended in accordance with the provisions of this Ordinance. Section 2 Effective date. That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law. Section 3 Conflict. All Ordinances or parts of Ordinances in conflict herewith shall be and the same are hereby repealed.
