ORDINANCE NO. 0_55-08 AN ORDINANCE GRANTING VARIATIONS TO ALLOW AN INTERNALLY ILLUMINATED SIGN MOUNTED ON A WALL WITH PLASTIC CHANNEL LETTERS AT 1248 STATE STREET (L.A. Tan) WHEREAS, L.A. Tan, hereinafter referred to as "the Petitioner," is an agent acting on behalf of the land owner of property generally located at 1248 State Street in Lemont, hereinafter referred to as the "the subject property," and legally described in Exhibit "A "; and WHEREAS, the applicant is seeking variations from the Unified Development Ordinance, §17.11.080.D.5 and §17.11.140.C.2, to allow an intemally illuminated sign and to allow plastic channel letters on a sign mounted on a wall; and, WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois conducted a Public Hearing on October 21, 2008; and, WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Southtown Star, a newspaper of general circulation within the Village; and, WHEREAS, the Planning and Zoning Commission has recommended approval of the request for variations to the Village Board with the findings of fact noted below; and, WHEREAS, the President and Board of Trustees of the Village has reviewed the matter herein and has determined that the same is in the best interest of the Village of Lemont, and herein adopts the following findings of fact: 1. The variation is in harmony with the general purpose and intent of the Unified Development Ordinance because it would not set a harmful precedent to recommend a variation for this sign because of distance, exterior lot lighting, elevation and landscaping. There is a just and unique cause. 2. The plight of the owner is due to unique circumstances because L.A. Tan will be the only tenant within its shopping center with an externally illuminated sign. 3. The variation will not alter the essential character of the locality and will not be a substantial detriment to adjacent property. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND WILL, ILLINOIS: SECTION 1: Variation. Two variations from §17.11.080.D.5 and §17.11.140.C.2 of the Unified Development Ordinance are granted to allow one internally illuminated sign mounted on a wall with plastic channel letters at the subject property. SECTION 2: Condition of Approval. The Petitioner shall develop the aforementioned sign in accordance with the photometric rendition of sign, dated 9- 26 -08, prepared by Sean Park attached hereto and incorporated herein as Exhibit `B ". SECTION 3: That the Village Clerk of the Village of Lemont be and is directed hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided. SECTION 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
