RESOLUTION NO. D 3-OS A RESOLUTION ENDORSING CHICAGO SOUTHLAND DEVELOPMENT, INC. AS THE COMMUNITY DEVELOPMENT BLOCK GRANT/H.O.M.E. APPLICANT AND ADMINISTRATOR OF ALL SINGLE FAMILY REHABILITATION FOR THE VILLAGE OF LEMONT WHEREAS, THE Constitution of the State of Illinois, 1970, Article VII, Section 10, authorizes units of local government to contract or otherwise associate among themselves in any manner not prohibited by law or ordinance; and WHEREAS, the Illinois Compiled Statutes, Chapter 5, Act. 220, entitled the Intergovernmental Cooperation Act, provided that any power or powers, privileges or authority exercised or which may be exercised by a unit of local government may be exercised and enjoyed jointly with any other unit of local government; and provides that any one or more units of local government may contract with any one or more units of local government to perform any governmental service, activity or undertaking which any of the local governing bodies entering into the Agreement is authorized by law to perform, provided that such Agreement shall be authorized by the governing body of each party to the Agreement; and WHEREAS, Chicago Southland Development, Inc (CSDI), an Illinois not - for -profit corporation, through its Board of Directors, has requested that the Village Board of Lemont, Illinois, support Community Development Block Grant (CDBG) and H.O.M.E. applications to be filed annually in 2008, through and including 2012, requesting single family rehabilitation funds in accordance with the rules and regulations as set forth by the Department of Housing and Urban Development and the County of Cook, Department of Planning and Development; and WHEREAS, such Village endorsement is required prior to the filing of said application with the County of Cook. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont, Illinois, as follows: 2 SECTION 1: That the preambles of this Resolution are incorporated herein by reference as if fully set forth herein. It is further acknowledged that CSDI and the Village of Lemont enter into a quasi - intergovernmental agreement to further support the mutual interests of the CDBG /H.O.M.E. single family rehabilitation program. SECTION 2: That the Village finds that the Department of Housing and Urban Development Single Family Rehabilitation Program and H.O.M.E. program available to certain municipalities which meet the criteria of the application as administered by the County of Cook, is necessary for the rehabilitation of certain qualified property within the Village of Lemont and is vital for the continuing improvement and development of specific properties within the Village of Lemont. SECTION 3: That in order to facilitate the CDBG and H.O.M.E. single family rehabilitation program to the citizens of the Village of Lemont, the Village President and the Village Board of Trustees of Lemont, Illinois, have determined that it is in the best interest of the Village to support and endorse CSDI for the purpose of preparing, presenting, and administering the aforementioned applications on behalf of the Village for the period of five (5) years, subject to termination as set forth in Section 4. SECTION 4: Both the Village and CSDI shall have the right to terminate the agreement beginning in the year 2008. The applicable party must give written notice of termination and said notice shall be sent via certified and regular U.S. Mail, postmarked no later than January 3`a of the year of cancellation. SECTION 5: That this Resolution shall be in full force and effect for HUD fiscal years 2008 through 2012 from and after its passage and approval as required by law. SMOLLEN, Village Clerk 4 VILLAGE OF LEMONT COOK, WILL & DU PAGE COUNTIES, ILLINOIS FAIR HOUSING ACTION PLAN PROGRAM YEAR 2008 The Village of Lemont presents the following Fair Housing Action Plan to fulfill its obligations to further fair housing during the 2008 Program Year: 1. The Village of Lemont has adopted Ordinance 757, Fair Housing Ordinance, to address issues related to fair housing. The Community Development Department is charged with administration of the Ordinance. During the 2008 project year, the ordinance will be reviewed and revised, if necessary, to reflect the Village's commitment to fair housing. 2. The Community Development Department will continue to apprise elected officials and staff of educational training opportunities related to fair housing, and will attend educational seminars as time and resources permit. 3. The Village of Lemont as a matter of policy annually reviews its adopted building and property maintenance codes for optimum compliance with life safety and handicap accessibility guidelines. During the 2008 program year, the Village will again conduct such reviews and make revisions as necessary. 4. The Village of Lemont has adopted a Taxpayer Bill of Rights Ordinance to protect the rights and responsibilities of the residents with regard to locally imposed and administered taxes of the Village of Lemont. 5. The Village of Lemont has contracted with Chicago Southland Development, Inc. to more efficiently administer its federally funded residential rehabilitation Community Development Block Grant Program and pledges to increase efforts to make residents aware of the benefits available under this program. 6. The Village of Lemont annually provides and will continue to budget funds for a Sidewalk Replacement Program to improve pedestrian safety and provide handicap access ramping on Village walkways. 7. The Village of Lemont will continue to provide discounts to seniors and the disabled on water and sewer bills, garbage service, and vehicle stickers. 8. The Village of Lemont will continue to provide a quarterly newsletter mailed to all residents, including tenants and homeowners, containing information on the social services and programs available in the Lemont community. 9. In November 2004, the Village of Lemont made a commitment to redevelop selected areas of the historic downtown. The resulting Master Plan expands housing choices by increasing the allowable densities in the downtown area. The Village of Lemont offers and supports the following programs aimed at furthering its Fair Housing Action Plan: 1. The Village of Lemont supports the efforts of Lemont Township to provide services for residents in need of general and housing assistance through the Township General Assistance Fund and a variety of programs offered. 2. The Village of Lemont participates in and supports the efforts of the Lemont Community Nutrition Network in providing daily hot meals and a "Meals on Wheels" program for the seniors and disabled members of the Lemont community. 3. The Village of Lemont financially supports the efforts of the PLOWS Council on Aging in providing assistance to seniors and disabled in a wide variety of housing, financial, transportation and energy - related issues. 4. The Village of Lemont financially supports the Lemont Open Food Pantry and the Christian Clergy Relief Fund to provide the necessities of life for the disadvantaged of the community. 5. The Village of Lemont supports the efforts of the Lemont Park District in providing transportation services through the PACE system for the handicapped, disabled and senior population of the community. 6. The Village of Lemont through its Police Department provides an Emergency Response Identification Program to address the special needs of mentally and physically impaired residents in the event of an emergency.
