AN ORDINANCE APPROVING A SPECIAL USE FOR OUTDOOR STORAGE AT 10990
ARCHER AVENUE IN LEMONT, IL
(Ratkovich Special Use)
WHEREAS, John Ratkovich Equities Limited Partnership, hereinafter referred to as the
"Petitioner," is the owner of property covering approximately located at 10990 Archer Avenue
(P1N# 22 -14- 401 -009) hereinafter referred to as "the subject property," and legally described and
depicted in Exhibit "A"; and
WHEREAS, the Petitioner is seeking a special use to allow outdoor storage on the subject
property; and
WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois
conducted a public hearing on April 21, 2010 for approval of the special use; and
WHEREAS, a notice of the aforesaid public hearing was made in the manner provided by
law and was published in the Lemont Reporter -Met, a newspaper of general circulation within the
Village; and
WHEREAS, the President and Board of Trustees of the Village has reviewed the matter
herein and has determined that the same is in the best interest of the Village of Lemont, and herein
adopts the finding of facts as set forth in Exhibit `B ".
NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND
WILL, ILLINOIS:.
SECTION 1: Special Use Approval. A special use is granted to allow outdoor storage
of construction contractor materials on the subject property.
SECTION 2: Conditions of Approval. The above special use shall be approved subject
to the following conditions:
1. A fence or other form of screening shall be added to the east property line within 60
days. The screening provided shall be at least as opaque as the screening presently
provided by the fence along the south property line. Upkeep shall be maintained on
all fences.
2. The screening provided along the south property line must remain in place.
3. The height of the outdoor storage may not exceed the height of the screening.
4. The special use approval shall expire two years from the date of this ordinance, unless
extended by the Village Board. Prior to the expiration of the two year period, at the
applicant's request, the Village shall re- evaluate the special use to determine whether
the use remains compatible with the surrounding area. If found to be compatible, the
special use approval will be extended by the Village Board for an additional two
years. If found to be incompatible, the special use approval shall expire. In
evaluating an extension of the special use approval, staff shall consider any registered
complaints about the special use operation and any changes in the surrounding land
uses.
5. No gas, petroleum or hazardous material shall be stored on the property.
SECTION 3: That the Village Clerk of the Village of Lemont be and is directed hereby
to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made
and provided.
SECTION 4: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication provided by law.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DuPAGE, ILLINOIS, on this 14th
day of June, 2010.

Exhibit B
Findings of Fact
1. The proposed special use does not involve any combustible or hazardous material and
therefore will not create any excessive demands on Village services.
2. The proposed special use is consistent with the existing land uses on surrounding property.
