VILLAGE OF LEMONT ORDINANCE 0 - /40 AN ORDINANCE PROVIDING FOR MISCELLANEOUS ADMINISTRATIVE FEES ADOPTED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 24th DAY OF MAY , 2010 Published in pamphlet form by Authority of the President and Board of Trustees of the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, this 24th day of May, 2010 Ordinance ©- AN ORDINANCE PROVIDING FOR MISCELLANEOUS ADMINISTRATIVE FEES WHEREAS, the Village of Lemont provides various services and materials as requested by individual members of the public which requires the expenditure of Village resources; and, WHEREAS, pursuant to Article 7, Section 9 of the Constitution of the State of Illinois: "Fees may be collected as provided by law and by ordinance and shall be deposited upon receipt with the treasurer of the unit" (ILCS Const. Art. 7, § 9). Now, Therefore, be it Ordained by the Village President and Board of Trustees of the Village of Lemont, Illinois, as Follows: SECTION 1: The Lemont Municipal Code is Amended by adding Chapter 3.55 as follows: Chapter 3.55 Miscellaneous Administrative Fees Sections: 3.55.010 Administrative Fee Schedule 3.55.020 Deferred Payment 3.55.030 Appeal 3.55.010 Administrative Fee Schedule The following fee schedule is hereby established to reimburse the Village for the cost of providing services and materials of a non - general nature to individual persons and businesses: 1. An administrative fee of • dollars ($&8:'60) shall be imposed upon an arrestee when posting bail or bond for any criminal, Village ordinance or bookable arrest, including, but not limited to warrants. 3.55.020 Deferred Payment The Village may waive payment of this fee at the time the materials or services are delivered. Provided, in such event the individual person or business receiving such material or service shall be required to pay such fee within 30 days. SECTION 2: That the Village Clerk of the Village of Lemont be and is directed hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided. SECTION 3: Should any Section or provision of this Ordinance be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the Ordinance as a whole or any part thereof other than the part declared to be invalid_ SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
