O-39-26 Annexing Territory Pursuant to 65 ILCS 5/7-1-13 (14611 Main Street)I Mf TNTT VILLAGE OF w9 418 Main Street ( Lemont, IL 60439 TO: Village Board Meeting FROM: George Schafer, Administration THROUGH: SUBJECT: An Ordinance Annexing Territory Pursuant to 65 ILCS 5/7-1-13 (14611 Main Street) DATE: August 10, 2026 SUMMARY/BACKGROUND Attached for consideration is an ordinance for annexation of approximately 0.413 acres of property at 14611 Main Street. The annexation was discussed at the April Committee of the Whole where the Board asked staff and legal to move forward with the process to annex the property. As discussed at the committee of the whole meeting. staff has been asked by neighboring property owners on Main Street to consider annexing the property at 14611 Main Street utilizing Section 7-1-13 of the Illinois Municipal Code, as it appears the parcel is completely surrounded by Village boundaries. The property has received several property maintenance and other citations through the Cook County Building & Zoning Department and still remains in nuisance status, according to the neighboring owners. Bringing properties into Village jurisdiction allows the Village to utilize its tools for nuisance abatement should additional issues arise rather than relying on the county. Annexing properties also ensures building permits and zoning entitlements are handled through the Village rather than through the county should the property develop. After discussion at the COW meeting, notification and other procedural steps have been followed by Village legal and the ordinance is now ready to be presented for consideration. ANALYSIS Annexation of unincorporated territories by municipalities has been a priority and directive set out by the Cook County Board President and other policy directives. These directives were discussed and incorporated into the Village's strategic planning efforts over the years with specific outcomes established to pursue annexation of unincorporated territory near or surrounded by the Village's corporate boundaries. The importance of these initiatives is not only to expand the Village's tax base, but also to exercise regulatory authority over areas adjacent and near the Village. Regulatory oversight of these areas is important to ensure development and zoning entitlements are consistent with the Village's long term plans and that they are are handled through the Village's development review process as opposed to the process and codes of the county or an adjacent municipality. LF,MONT, ILLINOIS 1 OF 1 ORDINANCE NUMBER 0-.',q-2026 AN ORDINANCE ANNEXING TERRITORY PURSUANT TO 65 ILCS 5/7-1-13 (14611 Main Street) WHEREAS, the Village of Lemont ("Village") is a non -home rule unit of government organized and operating under the authority of the Constitution and laws of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the Village's statutory powers under the Illinois Municipal Code; and WHEREAS, pursuant to Section 7-1-13 of the Illinois Municipal Code, 65 ILCS 5/7-1- 13, the Village has authority to annex unincorporated territory containing 60 acres or less that is wholly bounded by one or more municipalities; and WHEREAS, the Village desires to annex the territory commonly known as 14611 Main Street, located in unincorporated Cook County, consisting of approximately 0.413 acres in area, legally described in Exhibit A, attached to this Ordinance, and depicted on the plat of annexation attached to this Ordinance as Exhibit B ("Property"); and WHEREAS, the Property constitutes unincorporated territory containing 60 acres or less, is wholly bounded by the Village, is contiguous to the corporate limits of the Village, and is not within the corporate limits of any municipality; and WHEREAS, on July 24, 2026, written notice of the Village's intention to annex the Property was served by certified mail on the taxpayer of record of the Property as appears from the authentic tax records of Cook County (65 ILCS 5/7-1-13); and WHEREAS, on July 31, 2026, notice of the Village's intention to annex the Property was duly published in the Daily Southtown, a newspaper of general circulation within the Property to be annexed (65 ILCS 5/7-1-13); and WHEREAS, written notice of the Village's intention to annex the Property has been delivered to all persons, entities, and officials required to receive notice of the annexation in accordance with the Illinois Municipal Code (65 ILCS 5/7-1-1; 65 ILCS 5/7-1-13), and an affidavit of service is attached to this Ordinance as Exhibit C; and WHEREAS, the President and Board of Trustees of the Village of Lemont have found and determined that it is in the best interests of the Village that the Property be annexed to the Village. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont, Counties of Cook, Will, and DuPage, Illinois, as follows: SECTION 1: The President and Board of Trustees adopt the foregoing recitals as though fully set forth herein. All Exhibits to this Ordinance are incorporated herein by this reference. Page 1 of 3 SECTION 2: Pursuant to 65 ILCS 5/7-1-13 and all other applicable authority, the President and Board of Trustees find that the Property constitutes unincorporated territory containing 60 acres or less, is wholly bounded by the Village, and is not within the corporate limits of any municipality. SECTION 3: The Property legally described in Exhibit A and depicted in Exhibit B is hereby annexed to the Village of Lemont. SECTION 4: The Plat of Annexation of the Property, attached as Exhibit B, is hereby approved and found to be an accurate map of the Property for purposes of Section 7-1-40 of the Illinois Municipal Code, 65 ILCS 5/7-1-40. SECTION 5: The Village Clerk is hereby authorized and directed to: A. record, within 90 days after the passage of this Ordinance, in the Cook County Clerk's Recordings Division, a certified copy of this Ordinance together with an accurate map of the annexed territory, in accordance with Section 7-1-40 of the Illinois Municipal Code, 65 ILCS 5/7-1-40, and any affidavits or proofs of notice required by law; B. file or transmit copies of this Ordinance and the Plat of Annexation to the Cook County Clerk and the applicable election authorities as required by the Illinois Municipal Code, including Sections 7-1-1, 7-1-13, and 7-1-40, as applicable; and C. notify the election authorities, as defined in Section 7-1-1 of the Illinois Municipal Code, the Illinois Department of Transportation, and the U.S. Postal Service branch serving the Property, of the annexation by certified or registered mail within 30 days after the effective date of this Ordinance. SECTION 6: That all ordinances and resolutions, or parts thereof, in conflict with the provisions of this Ordinance are, to the extent of such conflict, superseded by this Ordinance. SECTION 7: This Ordinance shall be in full force and effect upon and after the occurrence of the following events: (i) passage, approval, and publication in pamphlet form, if required by law; and (ii) recordation with the Cook County Clerk's Recordings Division, of this Ordinance together with all attachments, exhibits, and affidavits of service as required by law.
