O-36-25 Amending O-3-25 and Approving an Amendment to the Final1 W74 418 Main Street I Lemont, IL 60439 TO: Village Board Meeting FROM: Jamie Tate, Community Development THROUGH: Jason Berry, CEcD, AICP, Economic & Community Development Director SUBJECT: An Ordinance Amending 0-3-25 and Approving an Amendment to the Final Planned Unit Development (PUD) for The Club at 46 Ed Bossert Drive in Lemont, IL DATE: July 13, 2026 SUMMARY/BACKGROUND Jerry Kulhanek of 308 Canal LLC is requesting approval of a Major Amendment to the Final Planned Unit Development (PUD) for The Club, located at 46 Ed Bossert Drive. The request amends Ordinance 0-3-25 to permit an accessory outdoor patio and wall signage on the three-story former ice house portion of the building. The proposed outdoor patio is located west of the existing building and includes landscaped green space, seating and dining areas, shade structures, and shipping container enclosure walls incorporated as architectural elements of the outdoor entertainment area. ANALYSIS Planning & Zoning Commission (PZC) The Planning & Zoning Commission conducted a public hearing on June 3, 2026, and voted 5- 0 to recommend approval of the Major Planned Unit Development Amendment, subject to conditions. Historic Preservation Commission (HPC) The Historic Preservation Commission reviewed the proposed signage and recommended approval of wall signage, subject to issuance of a Certificate of Appropriateness, while recommending denial of the proposed roof -mounted sign. The attached ordinance incorporates the Planning & Zoning Commission's recommendation, permits wall signage subject to Historic Preservation Commission review and approval through issuance of a Certificate of Appropriateness, and does not approve the proposed roof - mounted sign. Consistency with Village Policy Lemont 2030 Comprehensive Plan STAFF RECOMMENDATION Staff is recommending approval of the attached ordinance. BOARD ACTION REQUESTED A motion to approve the attached ordinance. O —3� �—? `" AN ORDINANCE AMENDING 0-3-25 AND APPROVING AN AMENDMENT TO THE FINAL PLANNED UNIT DEVELOPMENT (PUD) FOR THE CLUB AT 46 ED BOSSERT DRIVE IN LEMONT, IL (Signage and Outdoor Patio) WHEREAS, Jerry Kulhanek of 308 Canal LLC, (hereinafter referred to as the "Petitioner"), is the owner of the subject property comprised of three parcels covering approximately 1.7-acres located at 46 Ed Bossert Drive (PINS# 22-20-300-006, 22-20-300-005 and 22-20-300-027), legally described in Exhibit A (hereinafter referred to as the "Subject Property"); and WHEREAS, the Village Board approved a Final Planned Unit Development for The Club on January 27, 2025 by Ordinance 0-3-25; and WHEREAS, the Petitioner has requested a Major Amendment to Ordinance 0-3-25 to permit an accessory outdoor patio area and revised building signage; and WHEREAS, the Planning & Zoning Commission (PZC) conducted a public hearing on June 3, 2026 and voted to recommend approval of the requested amendment with conditions; and WHEREAS, the Historic Preservation Commission (HPC) reviewed the proposed signage and recommended against the proposed roof -mounted sign while indicating support for wall signage mounted to or painted on the building fagade, subject to issuance of a Certificate of Appropriateness (COA); WHEREAS, the proposed outdoor patio incorporates shipping container enclosure walls as an architectural element of the approved patio improvements. NOW, THEREFORE BE IT ORDAINED by the Village President and Board of Trustees of the Village of Lemont, Counties of Cook, DuPage, and Will, Illinois as follows: SECTION ONE: Incorporation of Recitals. The foregoing findings and recitals are hereby adopted as Section 1 of this Ordinance and are incorporated by reference as if set forth verbatim herein. SECTION TWO: Ordinance 0-3-25 is hereby amended as follows: 1. The outdoor patio improvements, including shipping container enclosure walls, landscaping, shade structures, gates, and associated site improvements, substantially consistent with Exhibit B and Exhibit C attached thereto. 2. Wall signage mounted to or painted on the building fagade shall be permitted, subject to review and approval by the Historic Preservation Commission and issuance of a Certificate of Appropriateness (COA). 3. Roof signs, including signs mounted above the parapet wall, are not approved as part of this Planned Unit Development amendment. SECTION THREE: Conditions of Approval. Approval of this Major Planned Unit Development Amendment shall be subject to the following conditions: 1. All required permits shall be obtained prior to installation of the approved improvements, as applicable. 2. The outdoor patio shall be subject to review and approval by the Lemont Fire Protection District for occupant load, emergency access, and means of egress. SECTION FOUR: Except as expressly amended herein, all provisions, conditions, exhibits, and requirements of Ordinance 0-3-25 shall remain in full force and effect. SECTION FIVE: That the Village Clerk of the Village of Lemont be and is directed hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided. SECTION SIX: That this Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
