SUMMARY/BACKGROUND
Gary R. Weber Associates, Inc. (GRWA) is assisting the Village with monitoring and
maintenance services for the detention basins that are Village maintained in the Kettering
Subdivision. GRWA provides the monitoring and reporting. GRWA hires Bedrock
Earthscapes, LLC to perform the actual maintenance work, as noted in their proposal.
The total shown in the project is $32,100.00.

Funds are included in the FY27 Operating Budget for this project.

ILLINOIS FOR 2026 MONITORING AND MAINTENANCE SERVICES — KETTERING
PONDS
WHEREAS the Village of Lemont, Counties of Cook, Will, and DuPage, Illinois, ("the
Village") is a municipality in the State of Illinois with full powers to enact Ordinances and adopt
Resolutions for the benefits of the residents of the Village; and
WHEREAS, the Village and Gary R. Weber Associates, Inc. wish to enter a professional
services agreement 2026 Monitoring and Maintenance Services — Kettering Ponds as further
outlined in the professional services agreement attached hereto as Exhibit A ("Agreement"); and
WHEREAS, the Mayor and Board of Trustees find that it is in the best interests of the
Village to authorize the Agreement attached hereto as Exhibit A.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, as follows:
SECTION 1:
That the above recitals and legislative findings are found to be true and correct and are
hereby incorporated herein and made a part hereof as if fully set forth in their entirety.
SECTION 2:
The Mayor and Board of Trustees of the Village of Lemont hereby approve the
Agreement with GRWA, Inc. in substantially the same form as attached hereto as Exhibit A,
subject to attorney review.
SECTION 3:
The Mayor and Clerk are hereby authorized, respectively, to execute the Agreement with
GRWA, Inc.
SECTION 4:
This Resolution, and its parts, are declared to be severable and any section, subsection,
sentence, clause, provision, or portion of this Resolution that is declared invalid such decision
shall not affect the validity of any other portion of this Resolution, which shall remain in full
force and effect.
SECTION 5:
All Resolutions and Ordinances in conflict herewith are hereby repealed to the extent of
such conflict.

SUBJECT: Proposal for 2026 Monitoring & Maintenance Services: Kettering Ponds Stormwater Facilities, Village of Lemont
Lemont, DuPage County, Illinois
Dear Mr. Hill:
Thank you for this opportunity to submit the following proposal for ecological services at the above referenced site. We
have developed the scope and pricing below for maintenance and monitoring of naturalized areas for the 2026 growing
seasons. The maintenance is subcontracted to Bedrock Earthscapes, LLC.
SCOPE OF SERVICES
Task 1: Site Monitoring Visits, Correspondence, & Project Management (2026) $2,300.00
1.1. Annua/Site Visit. Visit site annually during the growing season to assess the function of the stormwater control
structures and observe the overall condition and establishment of wetland and prairie buffer vegetation.
1.2. Vegetation Evaluation: Evaluative the establishment of native vegetation and invasive weed growth, to
determine the optimal period to target invasive weed species for control.
1.3. Email Updates Email updates of monitoring observations with recommendations following visits.
1.4. Annual Rgoor(. Provide a yearly summary report for the BMP basins and buffers. This report should include
photographs of the basins and should be delivered no later than January 31 following the year's completed
management activities.
1.5. Maintenance Log Report will document completed activities, weed control observations, and other
maintenance items.
1.6. Shoreline Erosion Notes: Soil erosion and sediment control observations within the basins will be documented
with recommendations for any needed repair.
1.7. Recommendations: Provide recommendations for the next growing season if changes in maintenance are
needed.
Task 2: 2026 Maintenance (includes burns) Bedrock Earthscapes, LLC. Maintenance: $20,400.00
Burns: $9,400.00
Total: $29,800.00
2.1 Burns: All basins will be burned in early spring.
2.2 Maintenance visits Will be made during May, June, July and September. The purpose of these visits will be a)
to control invasive woody and herbaceous plants through cutting and use of appropriate herbicides, and b) to
ensure progress toward continually improving the native areas' health and beauty.
2.3 Herbicide Treatments: All herbicide treatments will be made by licensed pesticide applicators using non-
restricted herbicides in accordance with prescribed material labeling.
2.4 Cattails: Cattails in the basin bottom will be treated on our September visits.
2.5 Mowing, Transitional Grass areas will be mowed to 6-8" in June and October.
2.6 Clearing of Grates: Cover grates on inlets and outlets in the basins will be cleared of accumulated debris during
regular visits.
2.7 Service Notes: Site service notes will be sent via e-mail by Bedrock Earthscapes, LLC after each maintenance
visit.

TERMS AND CONDITIONS
CLIENTS RESPONSIBILITIES
Client agrees to provide Landscape Architect with all information regarding existing conditions including boundary,
easements and restrictions, soils, utilities, existing uses, and topography. Landscape Architect may reasonably rely on the
accuracy and completeness of these items. Client agrees to advise Landscape Architect of any known or suspected
contaminants at the Project site. Client shall be solely responsible for all subsurface soil conditions. Client will obtain and
pay for all necessary permits from authorities having jurisdiction over the project.
ESTIMATED SCHEDULE
Landscape Architect shall render its services as expeditiously as is consistent with professional skill and care as well as
Landscape Architect's receipt of all necessary documents and/or information. During the course of the Project, anticipated
and unanticipated events may impact any Project schedule. Client acknowledges that significant changes to the Project
or construction schedule or budget, or to the Project's scope may require Additional Services of Landscape Architect.
TERMINATION
Either Client or Landscape Architect may terminate this Agreement upon seven days written notice with or without cause.
If terminated, Client agrees to pay Landscape Architect for all Basic and Additional Services rendered and Reimbursable
Expenses incurred up to the date of termination. Landscape Architect may suspend the performance of its services if
Client fails to pay Landscape Architect in full for services rendered or expenses incurred. Landscape Architect shall have
no liability because of such suspension of services or termination due to Client's nonpayment.
OWNERSHIP OF DOCUMENTS
Upon the parties signing this Agreement, Landscape Architect grants Client a nonexclusive license for the Client to use
Landscape Architect's documents as described in this Agreement, provided Client performs in accordance with the terms
of this Agreement. No other license is implied or granted under this Agreement. All documents of professional services
or products prepared by Landscape Architect, including but not limited to, drawings and specifications, are the property
of Landscape Architect. These documents shall not be reused on other projects without Landscape Architect's written
permission. Landscape Architect retains all rights, including copyrights, in its documents. Client or others cannot use
Landscape Architect's documents to complete this Project with others unless Landscape Architect is found to have
materially breached this Agreement and Client is not in breach of the contract.
MAINTENANCE
Client acknowledges and agrees that proper Project maintenance is required after the Project is complete. A lack of or
improper maintenance may result in damage to property or persons. Client further acknowledges and agrees that, as
between the parties to this Agreement, Client is solely responsible for the results of any lack of or improper maintenance.
MISCELLANEOUS PROVISIONS
GRWA, Inc.'s billing rates are subject to escalation each calendar year and are effective upon thirty (30) days' notice to
the Client.
Notwithstanding of any other term in this Agreement, Landscape Architect shall not control or be responsible for
construction means, methods, techniques, schedules, sequences or procedures; or for construction safety or any other
related programs; or for another parties' errors or omissions or for another parties' failure to complete their work or
services in accordance with Landscape Architect's documents.
Client agrees to indemnify, defend and hold Landscape Architect harmless from and against any and all claims, liabilities,
suits, demand, losses, costs and expenses, including, but not limited to, reasonable attorney's fees and all legal expenses
and fees incurred on appeal, and all interest thereon, accruing or resulting to any and all persons, firms or any other legal
entities on account of any damages or losses to property or persons, including injury or death, or economic losses, arising
out of the Project and/or the performance or non-performance of obligations under this Agreement, except to the extent
such damages or losses are found by a court or forum of competent jurisdiction to be solely caused by Landscape
Architect's negligent errors or omissions.
Should any legal proceeding be commenced between the parties to this Agreement seeking to enforce any of its provisions,
including, but not limited to, fee provisions, the prevailing party in such proceeding shall be entitled, in addition to such
other relief as may be granted, to a reasonable sum for attorneys' and expert witnesses' fees, which shall be determined
by the court or forum in such a proceeding or in a separate action brought for that purpose. For purposes of this provision,
a prevailing party shall include a party that dismisses an action for recovery hereunder in exchange for payment of the
sum allegedly due, performance of covenants allegedly breached, or consideration substantially equal to the relief sought
in the action or proceeding.
