SUMMARY/BACKGROUND
The applicants and property owners of 707 and 713 State Street, represented by attorney Lee
Virtel of Antonopoulos & Virtel, request approval of a Plat of Subdivision to adjust lot lines for
proper ownership. The Village Engineer has approved the Plat of Subdivision. The proposed
adjustments do not eliminate existing nonconformities; however, the applicants have
acknowledged these in written statements, as advised by the Village Attorney. As proposed,
the reconfigured lots comply with the minimum lot width and lot area standards of the R-4A
zoning district.There are no proposed improvements to the properties at this time.
ANALYSIS

The future land use in the Lemont 2030 Comprehensive Plan for this area is Infill Residential
(INF).
Planning & Zoning Commission (PZC)
The Final Plat of Subdivision for the Bozych Resubdivision was reviewed at the PZC meeting
held on September 3, 2025 and the PZC recommended (4-0) approval of the subdivision.

A RESOLUTION APPROVING A FINAL PLAT OF SUBDIVISION FOR 707 AND

(Bozych Resubdivision)
WHEREAS, Gina S. Sapienza, Christopher C. Hlavaty and Judy R. Hlavaty,
represented by attorney Lee Virtel, (the "Petitioners"), are the owners of the property covering
approximately 0.53-acres located at 707 State Street and 713 State Street (PINS# 22-29-215-
027-0000, 22-29-215-008-0000 and 22-29-215-028-0000), legally described in Exhibit A
(hereinafter referred to as the "Subject Property"); and
WHEREAS, the Petitioner submitted the Bozych Resubdivision for 707 and 713 State
Street by Kabal Surveying Company Order #251977 (hereinafter referred to as "Bozych
Resubdivision") provided in Exhibit B for final plat approval in accordance with the
requirements of the Lemont Unified Development Ordinance; and
WHEREAS, the Petitioner has filed an application with the Village of Lemont for a
Final Plat of Subdivision to reconfigure the existing lots that make up 707 and 713 State
Street, following a transfer of ownership; and
WHEREAS, the Planning & Zoning Commission (PZC) voted (4-0) to recommend
approval of the Bozych Plat of Resubdivision at the PZC meeting on September 3, 2025; and
WHEREAS, the Plat of Subdivision creates two (2) lots that conform to the R-4A
zoning district dimensional standards while allowing existing legally nonconforming
structures and site conditions, as permitted under the Lemont Unified Development
Ordinance, as further acknowledged by Petitioners in letters provided in Exhibit C; and
WHEREAS, nothing herein shall be construed to authorize the expansion,
enlargement, or intensification of any nonconforming structure or condition; and
WHEREAS, the Final Plat of Subdivision is in substantial conformance with the
physical development policies and standards of the Village of Lemont; and
WHEREAS, the President and Board of Trustees have determined that the proposed
plat of subdivision is in the best interest of the Village of Lemont.
BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont,
Counties of Cook, DuPage, and Will, Illinois, as follows:
SECTION ONE: The President and Board of Trustees hereby finds and determines
that the facts set forth in the preamble hereto are true and correct and hereby adopts same as
part of this Resolution.
SECTION TWO: The Final Plat of Subdivision for the Bozych Resubdivision,
drafted by Kabal Surveying Company, is hereby approved in substantially the form attached
hereto as Exhibit B.
SECTION THREE: That this Resolution shall be in full force and effect from and
after its passage and approval as provided by law.

Dear Ms. Tate:
By way of introduction, I purchased the residence commonly known as 707 State Street,
Lemont, Illinois 60439 from Dennis Bozych, Executor of the Estate of Eugene E. Bozych,
deceased on November 1, 2022. 1 have been advised by the attorney representing Mr. Bozych
and the Estate that the Village of Lemont is ready to approve the Bozych Resubdivision of which
I am the owner of Lot 1. In again reviewing the survey of the lot and residence that I purchased,
I understand that there exists various non -conforming situations that do not meet the Village
requirements at this time. I also understand that if it is ever necessary for me or subsequent
owners to rebuild any of the improvements more than fifty percent damaged or destroyed, all
Village of Lemont Building and Zoning Requirements must be met including lot lines and side -
yard requirements. I am informed by Mr, Bozych's attorney that a mylar of the resubdivision plat
will be presented for my signature shortly.

By way of introduction, we own the lot and residence commonly known as 713 State
Street, Lemont, Illinois 60439 and what is soon to be known as Lot 2 in the Bozych
Resubdivision, PIN: 22-29-215-008. We understand that, in the future, if any of the
improvements are damaged more than fifty percent of value or are totally destroyed, any re-
building of the improvements must be done in accordance with the Village of Lemont Building
and Zoning Requirements including back and side -yard setbacks and any other provisions of
the code. Our lot and residence is located upon Lot 2 of said Bozych Resubdivison, and we will
be executing the Mylar reproduction of the resubdivision in the very near future, and it will be
submitted for Village approval with the Final Plat Application.
