We discussed at the November Committee of the Whole and have the ordinance drafted for approval. QZ- AN ORDINANCE AMENDING CHAPTER 2.08 — BOARD OF TRUSTEES WHEREAS, the Village of Lemont ("Village") is an Illinois Municipal Corporation pursuant to the Illinois Constitution of 1970 and the Statutes of the State of Illinois; and WHEREAS, the Village President and Board of Trustees desire to amend a certain provision of the Lemont, Illinois Municipal Code ("Village Code") to align with changes to the Open Meetings Act and to broaden the ability of the public to provide electronic comments at village board meetings; and WHEREAS, the Village finds that it is in the best interests of the Village and its residents to amend Title 2 of the Village Code in the manner set forth below. NOW THEREFORE, BE IT ORDAINED by the Village President and Board of Trustees of the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, as follows: SECTION 1: The statements set forth in the preamble to this Ordinance are found to be true and correct and are incorporated into this Ordinance as if set forth in full. SECTION 2: That Chapter 2.08 ("Board of Trustees") of Title 2 ("Administration and Personnel") of the Village Code is amended as follows (additions in bold and underline; deletions in ): 2.08.10. — Meetings All regular board meetings shall be held at the ho 6:30 7�00 p.m. at the village hall on the second and fourth Mondays of every month. 2.08.015. — Electronic attendance at meeting rules. The village hereby adopts the following rules for electronic attendance at meetings, which riles permit a member of the public body to attend any meeting of a public body as defined in the Open Meetings Act (5 ILCS 120/1 et seq.) via electronic means. (1) Section 1. Rules statement. It is the decision of the village that any member of the corporate authority may attend any open or closed meeting of the corporate authority via electronic means, such as by telephone, video or internet connection; provided that such attendance is in compliance with these rules and any applicable laws. (2) Section 2. Prerequisites. A member of the corporate authority may attend a meeting electronically if the member meets the following conditions: a. The member should notify the clerk and village administration at least eight hours before the meeting, unless impractical, so that necessary communications equipment can be arranged. Inability to make the necessary technical arrangements will result in denial of a request for remote attendance. b. The member must assert one of the following three reasons why he is unable to physically attend the meeting: 1. The member cannot attend because of personal illness or disability; 2. The member cannot attend because of employment purposes or the business of the village; or 3. The member cannot attend because of a family or other emergency. 4. The member cannot attend because of unexpected childcare obligations. SECTION 3: Those provisions of the Village Code that have been expressly amended herein remain in full force and effect. SECTION 4: If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not affect any other provision of this ordinance. SECTION 5: All ordinances, resolutions, motions or orders in conflict with this ordinance are hereby repealed to the extent of such conflict. SECTION 6: This ordinance shall be in full force and effect upon its passage, approval and publications as provided by law.
