SUBJECT: A Resolution Accepting Detention Basin Improvements and Reducing a
Letter of Credit for the Kettering Subdivision

SUMMARY/BACKGROUND
M/I Homes of Chicago, LLC, developer of the Kettering Subdivision, has completed the
stormwater detention basin improvements serving the subdivision and has requested the
release of the Letter of Credit associated with these improvements.
Irrevocable Letter of Credit No. SLCLSTL12775, issued by US Bank in the amount of
$200,000.00, was originally provided to guarantee construction of the detention basin
improvements. Following inspection and review of the completed work, the Village Engineer
has determined that the improvements have been constructed in accordance with the
approved plans and recommends acceptance of the improvements and reduction of the Letter
of Credit to $0.00.
ANALYSIS
Acceptance of the detention basin improvements and reduction of the Letter of Credit is
consistent with the Village's subdivision development process and confirms that the required
stormwater improvements have been satisfactorily completed.

A RESOLUTION ACCEPTING DETENTION BASIN IMPROVEMENTS
AND REDUCING A LETTER OF CREDIT FOR THE KETTERING
SUBDIVISION
WHEREAS, pursuant to the Lemont Unified Development Ordinance of 2008 ("UDO"),
an owner or developer of a subdivision is required to deposit certain security or evidence thereof
with the Village of Lemont to guarantee the installation of public improvements; and
WHEREAS, in the matter of the Kettering Subdivision located within the Village of
Lemont, Irrevocable Letter of Credit No. SLCLSTL12775, issued by US Bank, in the amount of
$200,000.00, was deposited with the Village of Lemont to guarantee completion of the subdivision's
stormwater detention basin improvements; and
WHEREAS, M/I Homes of Chicago, LLC, developer of the Kettering Subdivision, has
completed the detention basin improvements and requested release of the aforementioned Letter of
Credit; and
WHEREAS, Bruce A. Hill, P.E., of HR Green, Inc., on behalf of the Village, has reviewed
the developer's request and has determined that the improvements have been completed in
accordance with approved plans and recommends reduction of the Letter of Credit to $0.00 and
acceptance of the detention basin improvements; and
WHEREAS, the developer has conveyed the detention basin property to the Village of
Lemont for ownership and maintenance.
NOW, THEREFORE BE IT RESOLVED by the Village President and Board of Trustees
of the Village of Lemont, Cook, Will, and DuPage Counties, Illinois, as follows:
SECTION 1: RECITALS
The above recitals and legislative findings are found to be true and correct and are hereby
incorporated herein as though fully set forth.
SECTION 2: ACCEPTANCE OF IMPROVEMENTS
The detention basin improvements serving the Kettering Subdivision are hereby accepted by
the Village of Lemont.
SECTION 3: LETTER OF CREDIT REDUCTION
Irrevocable Letter of Credit No. SLCLSTL12775, issued by US Bank, is hereby reduced to
a balance of $0.00.
