SUMMARY/BACKGROUND
The attached ordinance authorizes the execution of an annexation agreement between the
Village of Lemont and the Lemont Fire Protection District for property located at 15723, 15747
and 15783 West 127th Street. The subject property consists of four parcels totaling
approximately 3.68 acres located at the northeast corner of 127th Street and Walter Street.
Two of the parcels are currently located in unincorporated Cook County and must be annexed
into the Village prior to development.
The annexation agreement establishes the terms and conditions under which the property will
be annexed to the Village and developed. The property will be zoned Institutional (INT) and
developed with the Lemont Fire Protection District's new Fire Station No. 1, subject to
approval of a Planned Unit Development (PUD). The agreement also acknowledges the
continued residential use of the existing home located at 15723 West 127th Street for the
duration of the current occupant's residency, after which the structure will be removed as part
of the overall development of the fire station site.
ANALYSIS
The annexation agreement follows the Village's standard annexation framework and
establishes expectations related to zoning, development, and future permitting. The proposed
annexation represents a logical extension of the Village's corporate boundaries and will allow
the Lemont Fire Protection District to modernize and replace its existing Fire Station No. 1.
The Planning & Zoning Commission previously reviewed the associated development request
and recommended approval of the annexation, rezoning, and preliminary PUD.

STREET, LEMONT, ILLINOIS
WHEREAS, the Village of Lemont (the "Village") is an Illinois municipal corporation
located in Cook, DuPage, and Will Counties, Illinois; and
WHEREAS, the Lemont Fire Protection District (the "Owner") is the owner of certain real
property commonly known as 15723, 15747 and 15783 West 127th Street, Lemont, Illinois, and
legally described in Exhibit A attached hereto (the "Subject Property"); and
WHEREAS, the Subject Property is contiguous to the corporate limits of the Village and
is eligible for annexation pursuant to the Illinois Municipal Code, 65 ILCS 5/7-1-1 et seq.; and
WHEREAS, the Owner has filed a petition requesting annexation of the Subject Property
into the corporate limits of the Village; and
WHEREAS, the Village and the Owner desire to enter into an Annexation Agreement
pursuant to Division 15.1 of Article 11 of the Illinois Municipal Code (65 ILCS 5/11-15.1-1 et
seq.) setting forth the terms and conditions under which the Subject Property may be annexed and
developed; and
WHEREAS, a proposed Annexation Agreement between the Village and the Owner has
been prepared and presented to the Village Board; and
WHEREAS, the Village Board has determined that the execution of the Annexation
Agreement is in the best interests of the Village and is consistent with the Village's long-range
planning goals and policies.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the
Village of Lemont, Cook, DuPage, and Will Counties, Illinois, as follows:
Section l : The foregoing recitals are incorporated herein as though fully set forth.
Section 2: The Village President and Village Clerk are hereby authorized and directed
to execute an Annexation Agreement between the Village of Lemont and the Lemont Fire
Protection District, substantially in the form attached hereto as Exhibit B, subject to such minor
revisions as approved by the Village Attorney.
Section 3: If any section, paragraph, clause or provision of this ordinance shall be held
invalid, the invalidity thereof shall not affect any other provision of this ordinance.
Section 4: All ordinances, resolutions, motions or orders in conflict with this ordinance
are hereby repealed to the extent of such conflict.
Section 5: Upon execution, the Annexation Agreement shall be recorded with the
appropriate county recorder in accordance with applicable law.
Section 6: This ordinance shall be in full force and effect upon its passage, approval
and publication as provided by law.

ANNEXATION AGREEMENT
This Annexation Agreement ("Agreement') is made and entered into this day of
March, 2026 ("Effective Date") between the Village of Lemont, an Illinois municipal corporation
located in Cook, DuPage and Will Counties, Illinois (hereinafter "Village"), and the Lemont Fire
Protection District ("Owner" or "District'), individually "Party" and collectively "Parties."
WITNESSETH
WHEREAS, the Owner is the owner of the property located at 15723, 15747 and 15783
West 127`h Street and which is legally described on Exhibit A attached hereto and made a part
hereof ("Property"), which property is subject to this Agreement; and
WHEREAS, the Owner has submitted to the Village a petition for annexation of the
Property as shown on the Plat of Annexation attached hereto as Exhibit B and made a part hereof,
and
WHEREAS, the Property is contiguous to the Village and none of the Property is presently
within the corporate limits of any other municipality; and
WHEREAS, the Parties hereto wish to enter into this Agreement with respect to the
annexation of the Property to the Village and to other related matters pursuant to 65 ILCS 5111-
15.1-1 et seq., upon the terms and conditions contained in this Agreement; and
WHEREAS, all public hearings as required by law have been held by the appropriate
departments, commissions, boards, and other governmental bodies of the Village; and
WHEREAS, the annexation of the Property to the Village will be beneficial to the Village,
will properly and beneficially extend the corporate limits and the jurisdiction of the Village, and
will otherwise promote the proper growth and general welfare of the Village; and
WHEREAS, the Village is a Municipal Corporation of the State of Illinois and has in full
force and effect various ordinances and amendments thereto relating to the development and
zoning of real estate including, but not limited to, the Village's Unified Development Ordinance
("UDO"); and
WHEREAS, the Owner proposes to develop the Property along with other property
("Other Property") contiguous to the Property which is owned by the Owner and which is already
located in the Village with a new Fire Station No. 1; and
WHEREAS, the Village has agreed to permit the development of Fire Station No. 1
pursuant to the terms of this Agreement; and
WHEREAS, the Parties hereto desire the Property to be annexed to the Village on the
terms and conditions hereinafter set forth.
NOW, THEREFORE, for and in consideration of the foregoing preambles and mutual
covenants and agreements contained herein, the Parties hereto agree as follows:
1. Incorporation of Preambles. The foregoing preambles are restated and
incorporated herein by reference as though fully set forth herein.
2. Legal Conformance With Law. This Agreement is made pursuant to, and in
accordance with, the provisions of the Lemont Municipal Code and applicable provisions of the
Illinois Compiled Statutes.
3. Petition to Annex. The Owner has filed with the Village Clerk a duly executed
petition pursuant to 65 ILCS 5/7-1-8 to annex the Property to the Village.
4. Annexation. The Village hereby agrees to annex the Property upon the terms and
conditions of this Agreement, and the Parties respectively agree to do all things necessary and
appropriate to cause the Property to be annexed to the Village including the passage of necessary
ordinances of the Village.
5. Zoning and Development. Upon annexation, the Property and the Other Property
shall be zoned Institutional in accordance with the Village's UDO and shall be developed with
Fire Station No. 1 pursuant to the Planned Unit Development ordinance ("PUD") being adopted
by the Village at the District's request. The Village agrees that the current residential use and
building of the property located at 15723 West 1271h Street (PIN 22-29-309-007-0000) can
continue as long as Michael E. Madden, Sr. is living at that address. Within six (6) months of his
vacating those premises, the District agrees that it will apply for demolition permits at the Village
and Cook County, and will demolish the existing structure.
6. Utilities and Public Improvements. The extension of utilities or construction of
public improvements necessary for development of the Property and the Other Property shall be
at the sole cost of the Owner and subject to all applicable permitting, design and approval standards
of the Village and other applicable agencies.
7. Fees. The Owner shall be required to pay all applicable fees, including but not
limited to permit, license, and inspection fees at the time of future development of the Property
and the Other Property, in accordance with Village ordinances in effect at that time.
8. Existing Fire Station Property. The District hereby consents to the Village
rezoning its existing fire station located on Main Street, identified by PINs 22-20-305-044-0000,
22-20-305-046-0000 and 22-20-309-002-0000 (the "Existing Fire Station"), to the Downtown
(DD) Zoning District for fixture development. The Parties agree to cooperate in the preparation of
a redevelopment plan for the Existing Fire Station to enhance its value as a site for redevelopment
consistent with the Downtown (DD) Zoning District and other downtown development to the east.
The Parties agree and consent that the Existing Fire Station will be included in the TOD TIF
District.

9. Recording. This Agreement shall be recorded by the Village Clerk in the Cook
County Clerk's Recording Division at the expense of the Owner.
10. Term. This Agreement shall be binding upon the Parties for a term of twenty (20)
years from the Effective Date.
11. Invalidity. If any provision of this Agreement is held invalid, the validity of the
remainder shall not be affected.
12. Binding Effect. This Agreement shall inure to the benefit of, and be binding upon,
the successors and assigns of the Owner and the Village.
13. Approval. This Agreement shall not be effective until it is signed by all Parties and
recorded.
14. Hold Harmless. The Owner agrees to defend and hold harmless the Village from
any claims or legal actions arising out of or related to this annexation.
15. No Liability of Village Officials. No agreement or undertaking of the Village
contained in this Agreement shall not be deemed to be a personal covenant, agreement or
undertaking of any officer, employee or agent of the Village and no officer, employee or agent of
the Village shall be personally liable under this Agreement or be subject to any personally liability
in connection with or arising out of the execution, delivery and performance or nonperformance
of this Agreement.
16. Notices. All notices, demands, requests and other communications necessary or
desirable to be served under this Agreement shall be in writing and shall be either personally
delivered or delivered to the Party or the Party's attorney by (i) email, (ii) prepaid same -day or
overnight delivery service (such as Federal Express or UPS), with proof of delivery requested, or
(iii) United States registered or certified mail, return receipt requested, postage prepaid, in each
case addressed as follows:
