O-18-26 Authorizing the Acquisition of Certain Real Estate for a Public Purpose (Kettering Subdivision)` (Z12—(e,7 19 418 Main Street I Lemont, IL 60439 TO: Village Board Meeting FROM: Jason Berry, Community Development THROUGH: George Schafer, Village Administrator SUBJECT: An Ordinance Authorizing the Acquisition of Certain Real Estate for a Public Purpose (Kettering Subdivision) DATE: March 9, 2026 SUMMARY/BACKGROUND M/1 Homes of Chicago, LLC, developer of the Kettering Subdivision, has completed the construction of several stormwater detention basins serving the subdivision. As part of the subdivision development process, these detention basin properties are being conveyed to the Village for long-term ownership and maintenance. The properties being conveyed consist of Lots 254, 255, 257, and 258 in the Kettering Subdivision. Acceptance of these parcels will allow the Village to assume ownership and maintenance responsibility for the detention basin facilities serving the subdivision. ANALYSIS Acceptance of the detention basin properties is consistent with the Village's subdivision development process and ensures that stormwater management facilities serving the subdivision are owned and maintained by the Village. Consistency with Village Policy STAFF RECOMMENDATION Approve the ordinance. BOARD ACTION REQUESTED Motion to approve the ordinance. O- 1 1 -26 AN ORDINANCE AUTHORIZING THE ACQUISITION OF CERTAIN REAL ESTATE FOR A PUBLIC PURPOSE (KETTERING SUBDIVISION) WHEREAS, the Village of Lemont is a home rule municipality pursuant to Article VII, Section 6 of the Illinois Constitution and has the authority to acquire property for public purposes; and WHEREAS, M/I Homes of Chicago, LLC, developer of the Kettering Subdivision, has constructed stormwater detention basin improvements to serve this subdivision; and WHEREAS, the developer has offered to convey certain real property containing detention basin facilities to the Village of Lemont for public ownership and maintenance; and WHEREAS, the property to be conveyed consists of certain real property located within the Kettering Subdivision, legally described in Exhibit A attached hereto; and WHEREAS, the Village Board finds that acceptance of the property will serve a valid public purpose by allowing the Village to own, operate, and maintain stormwater detention facilities serving the Kettering Subdivision. NOW, THEREFORE BE IT ORDAINED by the Village President and Board of Trustees of the Village of Lemont, Cook, Will, and DuPage Counties, Illinois, as follows: SECTION 1: RECITALS The foregoing recitals are hereby incorporated herein and made a part hereof as if fully set forth in this section. SECTION 2: AUTHORIZATION OF PROPERTY ACQUISITION The Village of Lemont is hereby authorized to accept the conveyance of certain real property from M/I Homes of Chicago, LLC, consisting of Lots 254, 255, 257, and 258 in the Kettering Subdivision, for the purpose of owning and maintaining the detention basin improvements located thereon. SECTION 3: EXECUTION OF DOCUMENTS The Village President and Village Clerk are hereby authorized and directed to execute and attest to any and all documents necessary to effectuate the acquisition of the property described herein, including the acceptance and recording of the Quitclaim Deed. SECTION 4: SEVERABILITY If any section, paragraph, clause, or provision of this Ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this Ordinance. SECTION 5: EFFECTIVE DATE This Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law.
