AN ORDINANCE DISCONNECTING CERTAIN PROPERTY
LOCATED AT 17025 DAVEY ROAD
IN LEMONT, ILLINOIS
WHEREAS, a disconnection petition, signed by the owner of record of all of the property
covered thereby, was filed with the Village of Lemont, Counties of Cook, Will and DuPage, Illinois,
("the Village") by Ann J. Dralle, as Trustee under Truste Agreement dated September 18, 2014 and
known as the Ann J. Dralle Trust, (the "Property Owner") on April 15, 2025, a copy of which is
attached hereto as Exhibit A, and made part hereof (the "Disconnection Petition"), and the required
County Cleric's Certificate, showing that all taxes and assessments due the Village, relative to the
Subject Property, have been paid, was filed with the Village by the Property Owner on April 15,
2025, a copy of which is attached hereto as Exhibit B and made part hereof (the "County Clerk
Certificate"), requesting disconnection for the property commonly known as 17025 Davey Road
and legally described in Section 2 below (the "Subject Property"), from the Village, pursuant to 65
ILCS 5/1-3-4; and
WHEREAS, more than thirty (30) days have passed since the filing of the Disconnection
Petition and County Clerk's Certificate; and
WHEREAS, the Village Board of Trustees of the Village has considered the Property
Owner's disconnection request, relative to the Subject Property; and
WHEREAS, a plat of disconnection for the Subject Property has been submitted to the
Village and found to be acceptable, and it attached hereto as Exhibit C and mad part hereof (the
"Plat of Disconnection"); and

WHEREAS, it is in the best interests of the Village that the Subject Property be
disconnected from the Village;
NOW THEREFORE, be it ordained by the President and Board of Trustees of the Village
of Lemont, Cook, DuPage and Will County, Illinois as follows:
SECTION 1: That the above recitals and legislative findings are found to be true and
correct and are hereby incorporated herein and made a part hereof as if fully set forth in their
entirety.
SECTION 2: That the following described property is, pursuant to 65 ILCS 5/7-3-4,
hereby disconnected from the corporate limits of the Village:

(90) days of the effective date of this Ordinance:
A. A copy of this Ordinance, certified by the Village Clerk; and
B. The Plat of Disconnection; said Plat of Disconnection to be attached to the aforesaid
certified copy of this Ordinance.
SECTION 4: That the Village Clerk is hereby directed to notify the election authority
having jurisdiction in the territory hereby annexed (the Will County Clerk), and the post office
branch serving the Subject Property hereby disconnected, of said disconnection, by certified mail,
return receipt requested within thirty (30) days of the adoption of this Ordinance.

SECTION 5: That the various provisions of this Ordinance are to be considered severable,
and if any part or portion of this Ordinance shall be held invalid by any court of competent
jurisdiction, such decision shall not affect the validity of the remaining provisions of this
Ordinance.
SECTION 6: That all Ordinances or parts of Ordinances in conflict or which are
inconsistent with this Ordinance shall be repealed to the extent of any such conflict or
inconsistency.
SECTION 7: That this Ordinance shall be in full force and effect after its adoption and
approval as provided by law.

THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DUPAGE, ILLINOIS, ON

I, the undersigned Petitioner, owner of record of a majority of the area of the land herein
requested to be disconnected, respectfully represent, under oath, that all conditions required for
disconnection from the Village of Lemont pursuant to and in accordance with Illinois Municipal
Code Chapter 65 Illinois Compiled Statutes Section 5/7-3-4 et. Seq. have been met and do hereby
state under oath to wit:
1. That this Petition is signed by the owners of record of a majority of the area of land in the
territory legally described on Exhibit A and commonly known as:
17025 Davey Road, Eemont, IL, approximately 22.58 acres
2. That the described territory is within the corporate limits of the Village of Lemont and rests
upon the border of the Village of Lemont's corporate boundaries.
3. Attached to this Petition is a certificate of the Will County Clerk showing that all Village
taxes or assessments due and owing for the subject property are fully paid.
4. That this Petition is presented for passage of an ordinance disconnecting the subject
property. Such an ordinance shall not be considered or passed within 30 days of the
submission of this Petition pursuant to 65 ILCS 5/7-3-4.
WHEREFORE, the Petitioner, respectfully requests the Corporate Authorities of the
Village of Lemont to disconnect the subject property, by ordinance, from the Village of Lemont.
