SUMMARY/BACKGROUND
HR Green is assisting the Village with design engineering services for a couple of additional
locations on top of the yearly water main improvements project. The existing 8-inch water
main on Ed Bossert Drive that runs underneath the Canadian National (CN) Railroad has
experienced multiple leaks during the recent year, so it needs to be replaced. Currently, the 8-
inch water main underneath Ed Bossert Drive is one of two water mains that cross the CN RR
and feeds the downtown area of Lemont. Adding another water main that crosses the CN RR
would be a good idea for proper redundancy. Funding will come from the Water Sewer Fund.
The time & material, not to exceed, fees for the project are $59,500.00. with these costs being
solely based on how difficult the CN Permit application process is.
As outlined in the Agreement, the streets included in this year's water main improvements
project will be:

• Talcott Avenue - North of Turnabout Pizza

WHEREAS the Village of Lemont, Counties of Cook, Will, and DuPage, Illinois, ("the
Village") is a municipality in the State of Illinois with full powers to enact Ordinances and adopt
Resolutions for the benefits of the residents of the Village; and
WHEREAS, the Village and HR Green, Inc. wish to enter a professional services
agreement for FY27 Water Main Improvements CN Railroad Crossings Design Engineering as
further outlined in the professional services agreement attached hereto as Exhibit A
("Agreement"); and
WHEREAS, the Mayor and Board of Trustees find that it is in the best interests of the
Village to authorize the Agreement attached hereto as Exhibit A.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, as follows:
SECTION 1:
That the above recitals and legislative findings are found to be true and correct and are
hereby incorporated herein and made a part hereof as if fully set forth in their entirety.
SECTION 2:
The Mayor and Board of Trustees of the Village of Lemont hereby approve the
Agreement with HR Green, Inc. in substantially the same form as attached hereto as Exhibit A,
subject to attorney review.
SECTION 3:
The Mayor and Cleric are hereby authorized, respectively, to execute the Agreement with
HR Green, Inc.
SECTION 4:
This Resolution, and its parts, are declared to be severable and any section, subsection,
sentence, clause, provision, or portion of this Resolution that is declared invalid such decision
shall not affect the validity of any other portion of this Resolution, which shall remain in full
force and effect.
SECTION 5:
All Resolutions and Ordinances in conflict herewith are hereby repealed to the extent of
such conflict.

THIS AGREEMENT is between Village of Lemont (hereafter "CLIENT") and HR Green, Inc.
(hereafter "COMPANY").
1.0 Project Understanding
1.1 General Understanding
The CLIENT has identified a need for water main improvements at the following locations:
Main Street to Canal Street with CN Railroad Crossing at the Lemont Metra
Station.
o Replacement of failing water main.
Talcott Avenue from Main Street to Pruxne Street with CN Railroad Crossing just
north of Main Street.
o Installation of new water main.
The project is anticipated to consist of installing approximately 200 Lin Ft. of a new 8-inch,
ductile iron main, and 200 Lin Ft. of a new 10-inch ductile iron main by the directional
boring method. The project will also include abandonment of leaking water main and
patching associated with the water main work under existing pavement.
1.2 Design Criteria/Assumptions
The engineering and contract documents will be developed according to current
AWWA Standards, the Village of Lemont Code Ordinances, and all applicable local
and federal requirements. These include the following:
a. Standard Specifications for Water and Sewer Main Construction in Illinois
b. Metropolitan Water Reclamation District's (MWRD) Watershed
Management Ordnance
c. Illinois Environmental Protection Agency (IEPA) Regulations
d. Canadian National Railroad crossing requirements
• All water main replacement will be completed within CLIENT's owned right-of-way. No
easements are anticipated for the project.
2.0 Scope of Services
The CLIENT agrees to employ COMPANY to perform the following services:
Preliminary and General Work
2.1 Survey - COMPANY will provide topographic survey services that will include the
following:
a. Right of Way and Topographic Survey - COMPANY will recover existing right-of-
way (ROW) lines and conduct a topographic survey for approximately 400 feet at
Location No. 1 and 300 feet at Location No. 2 specified above. COMPANY will
calculate the existing ROW as shown on the existing ROW documents (provided
by CLIENT) and/or adjacent recorded plats of subdivision to include on the base
map. The survey will include visible existing features and improvements at ground
level within the existing right of way plus five (5) feet on each side. Existing utilities
will be surveyed from visible flags or markings. Storm sewer, sanitary sewer, and

water main structures will be surveyed including rim elevation, invert pipe size,
direction and elevation as observed at unlocked manholes. Survey will reference
existing NGS control stations on the Illinois State Plane Coordinate System East
Zone NAD83 (2011) and NAVD88 (US Survey Feet). A base map will be
completed in AutoCAD Civi13D release 2023 for use by COMPANY for internal
design.
2.2 Subsurface geotechnical investigation — COMPANY will hire a sub -consultant as
part of this contract to perform geotechnical investigation as required by the
railroad crossing permit. This work will include the following:
a. Boreholes at each end of the crossing drilled to a depth 20 feet below the
proposed crossing depth.
b. Soil samples collected at 3-foot intervals to a depth of 15 feet.
c. Soil classification testing.
d. Monitoring of groundwater elevation via piezometer/monitoring well.
e. Laboratory testing to provide IEPA LPC-663 certification documents.
f. Geotechnical report with recommendations for trenchless construction
methods.
Design Phase Services
2.3 Coordinate with utility companies to resolve possible conflicts with their existing
facilities within the project limits and any specific construction requirements (e.g.,
crossing, separation, etc.).
2.4 Provide Engineering Plans with proposed line and grade of the proposed water
main, recommended locations for valves, fire hydrants, reconnections to existing
services, and reconnections to the existing water main.
2.5 Prepare construction drawings anticipated as the following 18 Sheets (for 50% and
100% design stages):

2.6 Prepare construction specifications and contract documents using CLIENT and
Illinois DOT Standard Specifications (for 50% and 100% design stages).
2.7 Prepare an Opinion of Probable Cost for the project at the 50% complete
milestone. Provide a final Opinion of Probable Cost for the project to file with the
completed documents.
2.8 Submit three (3) copies of the drawings, specifications, contract documents, and
Opinion of Probable Cost at the 50% complete milestone to CLIENT for review.
2.9 Provide an internal quality assurance and quality control review of final documents.
2.10 Develop a final project schedule for advertisement, bidding, and construction
completion.
2.11 Provide completed IEPA Construction permits for the CLIENT's signature.
COMPANY will submit applications to the Illinois Environmental Protection Agency
(IEPA) for review and approval.
2.12 Provide a Stormwater Permit Application in accordance with the CLIENT's local
Stormwater Management Ordinance. Due to the size of the project, it is anticipated
that this project will qualify as no permit needed.
2.13 Provide a submittal as required to the Canadian National Railway for permit
required to cross under the tracks at the proposed locations.

This schedule was prepared to include reasonable allowances for review and approval

Contractor provides a schedule for construction.
2. Additional GIS data collection or surveying other than the design data collection and
base mapping as outlined above. To be included in the Construction Engineering
agreement.
3. Property boundary research, including subdivision maps, right-of-way widths, property
lines, and property ownership information other than readily available property line
information from the County.

7.0 Professional Services Fee
7.1 Fees
The fee for services will be based on COMPANY standard hourly rates current at the time
the AGREEMENT is signed. These standard hourly rates are subject to change upon 30
days' written notice. Non -salary expenses directly attributable to the project such as: (1)
living and traveling expenses of employees when away from the home office on business
connected with the project; (2) identifiable communication expenses; (3) identifiable
reproduction costs applicable to the work; and (4) outside services will be charged in
accordance with the rates current at the time the service is done.
7.2 Invoices
Invoices for COMPANY's services will be submitted, on a monthly basis. Invoices will be
due and payable upon receipt in accordance with the Illinois Prompt Payment Act 50ILCS
505. If any invoice is not paid within these timelines, COMPANY may, without waiving any
claim or right against the CLIENT, and without liability whatsoever to the CLIENT, suspend
or terminate the performance of services.
7.3 Extra Services
Any service required but not included as part of this AGREEMENT shall be considered extra
services. Extra services will be billed on a Time and Material basis with prior approval of
the CLIENT.
7.4 Exclusion
This fee does not include attendance at any meetings or public hearings other than those
specifically listed in the Scope of Services. These service items are considered extra and
are billed separately on an hourly basis.
7.5 Payment
The CLIENT AGREES to pay COMPANY on the following basis:
Time and material (T&M) basis with a Not to Exceed fee of $59,500.

8.0 Terms and Conditions
This Agreement is an addendum to and is considered part of the Master Agreement
between CLIENT and COMPANY. All terms and conditions contained in that agreement
apply to this Agreement.
This AGREEMENT is approved and accepted by the CLIENT and COMPANY upon both
parties signing and dating the AGREEMENT. Services will not begin until COMPANY
receives a signed agreement. COMPANY's services shall be limited to those expressly
set forth in this AGREEMENT and COMPANY shall have no other obligations or
responsibilities for the Project except as agreed to in writing. The effective date of the
AGREEMENT shall be the last date entered below.
